Hickman Rd. and electronically via Zoom. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R. Charles Bottenberg (electronically), Chris Crone, Larry R. Lyon, Anna Bergman Pierce (electronically), Ben Sinclair. Absent: None. Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne, Community Development Director Andy Kass, Planning Coordinator Melissa DeBoer, Accounting Manager Rachel Bruns, Human Resources Director Michelle Lindsay, Parks & Recreation Director Matt Jermier, Public Works Director/City Engineer Rudy Koester, Police Chief Chad McCluskey, Police Officer Corby Robbins, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum (E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (F) Monthly Mayor’s Report – Mayor Clarke noted that players and volunteers are needed for the upcoming youth Miracle League. The Waukee Betterment Foundation is accepting funding requests for their 2023 endowment fund. The Waukee Area Chamber of Commerce is hosting the annual Economic Development Bus Tour on Sept. 14. (G) Presentations: 1) Denman & Company on upcoming FY2023 audit – Presentation made by David Ellis with Denman & Company as required by GASB regulations. (H) Public Hearings: 1) On an ordinance to amend Chapter 165, Zoning Regulations, Definitions and General Regulations, by amending Section 165.02, Definitions – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. City Administrator Deets noted that the City had received a letter from the American Civil Liberties Union (ACLU) expressing concern with the City ordinance definition of an “adult cabaret”, specifically how that definition could restrict male and female impersonators. The types of activities noted by the ACLU are allowed in specific zoning districts and drag shows are not currently restricted if they do not fall under the definition of an “adult entertainment” business. The proposed ordinance updates definitions to use current terminology; the ordinance does not change what activities are allowed. No comments were made by the public in attendance. (I) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 165, Zoning Regulations, Definitions and General Regulations, by amending Section 165.02, Definitions [introduction; first reading] – Council Member Sinclair introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Crone. City Administrator Deets stated that the proposed ordinance continued to protect the City regarding adult-oriented businesses. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (J) Action Items: 1) Consent Agenda: Council Member Lyon moved to approve the Consent Agenda; seconded by Council Member Crone.
