August 7, 2023
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R.
Charles Bottenberg (electronically), Chris Crone, Larry R. Lyon, Anna Bergman Pierce
(electronically), Ben Sinclair. Absent: None.
Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne,
Community Development Director Andy Kass, Planning Coordinator Melissa DeBoer,
Accounting Manager Rachel Bruns, Human Resources Director Michelle Lindsay, Parks &
Recreation Director Matt Jermier, Public Works Director/City Engineer Rudy Koester, Police
Chief Chad McCluskey, Police Officer Corby Robbins, City Clerk Rebecca D. Schuett, City
Attorney Steve Brick.

(E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council
Member Sinclair. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair. Nays: None.
Motion carried 5 – 0.
(F) Monthly Mayor’s Report – Mayor Clarke noted that players and volunteers are needed for the
upcoming youth Miracle League. The Waukee Betterment Foundation is accepting funding
requests for their 2023 endowment fund. The Waukee Area Chamber of Commerce is hosting
the annual Economic Development Bus Tour on Sept. 14.
(G) Presentations:
1) Denman & Company on upcoming FY2023 audit – Presentation made by David Ellis with
Denman & Company as required by GASB regulations.
(H) Public Hearings:
1) On an ordinance to amend Chapter 165, Zoning Regulations, Definitions and General
Regulations, by amending Section 165.02, Definitions – Mayor Clarke opened the public
hearing and asked if any written correspondence had been received; City Clerk Schuett
replied that none had been received in the clerk’s office. City Administrator Deets noted that
the City had received a letter from the American Civil Liberties Union (ACLU) expressing
concern with the City ordinance definition of an “adult cabaret”, specifically how that
definition could restrict male and female impersonators. The types of activities noted by the
ACLU are allowed in specific zoning districts and drag shows are not currently restricted if
they do not fall under the definition of an “adult entertainment” business. The proposed
ordinance updates definitions to use current terminology; the ordinance does not change
what activities are allowed. No comments were made by the public in attendance.
(I) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 165, Zoning
Regulations, Definitions and General Regulations, by amending Section 165.02,
Definitions [introduction; first reading] – Council Member Sinclair introduced the
ordinance and moved to approve the first reading in title only; seconded by Council Member
Crone. City Administrator Deets stated that the proposed ordinance continued to protect the
City regarding adult-oriented businesses. Results of vote: Ayes: Bottenberg, Crone, Lyon,
Pierce, Sinclair. Nays: None. Motion carried 5 – 0.
(J) Action Items:
1) Consent Agenda: Council Member Lyon moved to approve the Consent Agenda; seconded
by Council Member Crone. Results of vote: Ayes: Bottenberg, Crone, Lyon, Pierce, Sinclair.

8) Spring Meadows
A. Resolution: Consideration of approval of a resolution approving Development
Agreement with Waukee Partnership, LLC – Council Member Crone moved to
approve the resolution; seconded by Council Member Lyon. Community Development
Director Kass presented on the development agreement, preliminary plat and
construction drawings. The development agreement primarily addresses T Ave.
improvements, including extending paving to connect with the City’s T Ave. Corridor
Improvements Project to the north. The proposed plat consists of 344 single family lots
on approximately 120 acres; 99 of the lots are smaller in accordance with a previously
approved planned development overlay. Mr. Kass reviewed the parkland area, including
recreational trail extensions, and landscape buffering. Council Member Sinclair
expressed his pleasure in seeing more greenbelt connections. Results of vote: Ayes:

10) Resolution: Consideration of approval of a resolution approving an agreement
between the City and Larson Construction Co, Inc., and Musco Sports Lighting, LLC,
a/k/a Iowa Sports Turf Management – Council Member Lyon moved to approve the
resolution; seconded by Council Member Sinclair. Parks & Recreation Director Jermier
briefly reviewed the agreement to improve Triumph Park ballfield drainage, noting that the
work would take place over the next several weeks. Council Member Lyon asked if the
improvements would correct a drainage issue that he had mentioned to Mr. Jermier; Mr.
Jermier replied that Council Member Lyon’s concern was a different issue related to erosion
around drains and that it was still on the project punch list. Mayor Clarke voiced her
appreciation for all the work that went into the agreements. Results of vote: Ayes:

Recreation Director Jermier reviewed the agreement which includes on-site maintenance
training for City staff. He added that both agreements would be paid for with Triumph Park

A. Call to Order – The special meeting of the Waukee City Council was called to order by Mayor Pro Tem
Bottenberg at 5:31 p.m. at Waukee City Hall, 230 W. Hickman Rd.

President Rick Kyser and Board Member Logan Galloway presented the organization’s history,
mission statement, past program highlights, class projects and 2023 strategic objectives.
2) City Partners Presentation: Waukee Area Historical Society – Terry Snyder and Kelly Nizzi
with the Waukee Area Historical Society discussed their efforts with fundraising, adding artifacts to
their collection, finding a museum space or some other means of sharing their collection, possible
activities to commemorate the founding of the city, and the upcoming Wauktoberfest event.
3) PFM/Central Iowa Waterworks (CIWW) presentation – Matt Stoffel with PFM Financial Advisors,
LLC, presented on an agreement approval timeline and financial assumptions.
4) FY2022-2023 Strategic Plan: Dallas Center Annexation Moratorium Agreement update –
Community Development Director Kass reviewed the current and proposed moratorium agreement
area.
5) FY2022-2023 Strategic Plan: Pavement management study update – Larry Stevens with HR
Green discussed the study, reviewing current street system conditions and areas of concerns, data
collection methods and analysis, and treatment strategies.
6) FY2023-2024 Strategic Plan: Traffic Signal Synchronization Phase 2 report – Public Works
Director/City Engineer Koester and Andrew Houchin with Snyder & Associates, Inc., reviewed the
Automated Traffic Signal Performance Measures (ATSPM), the project timeline to date, metrics
results and next steps, including the installation of flashing yellow turn arrows at certain
intersections.

7) FY2023-2024 Strategic Plan: Aquatic Facility/Pool Project discussion – City Administrator
Deets discussed a proposed professional services agreement for an aquatic facility needs
analysis.
8) FY2023-2024 Strategic Plan: Economic Development quarterly report – Director of Economic
Development Brown reviewed quarterly activities.
9) FY2023-2024 Strategic Plan: Employee Compensation review – Human Resources Director
Lindsay discussed compensation philosophy; the periodic evaluation of each job description, job
grade and compensation level; annual general wage increases; and the compensation plan review
and approval process.
10) Waukee Police Department Strategic Plan 2023-2027 – Police Chief McCluskey presented an
overview of the planning process, goals and focus, and planning project timeline.
11) Road and infrastructure project updates – Public Works Director/City Engineer Koester
provided an update on various projects under construction.
