Roll Call: The following members were present: Cole Bisgard Juan Garcia Bryce Johnson Emily Schultz (arrived 5:33 PM) Members not present: Tanner Westberg City Staff Present: Melissa DeBoer, Planning Coordinator, Bill Mettee, Planner and Dawn Young, Development Services Specialist Public Present: Noah Webster & Taylor Lee, 105 Bel Aire Drive Michael Lause, 100 Northview Drive Cory & Allison Millmier, 2510 SE Kettleridge Lane Brandon & Sandra Fast, 2515 SE Florence Drive Agenda Approval: The agenda for the August 31, 2023 meeting agenda was approved on a motion by Cole Bisgard and seconded by Bryce Johnson. On voice vote, all ayes. The minutes of the June 29, 2023 meeting were approved on a motion by Cole Bisgard, seconded by Bryce Johnson. On voice vote, all ayes. New Business: Consider a variance request from Noah Webster of 105 Bel Aire Drive from Waukee Municipal Code 165.14 to allow a 6-foot fence to remain within the required front yard setback. City Planner, Bill Mettee, presented an outline of the project, as shown in the staff report. The applicant is requesting a variance to allow a 6-foot fence to remain on the property placed within the required 20-foot front yard setback along 1st Street. The applicant spoke and explained that his fence is for his dogs; he would like a screen to limit barking at passersby, and for privacy. Board of Adjustment Meeting Minutes August 31, 2023 Discussion as follows: • Michael Lause, 100 Northview Drive, a neighbor located to the north, spoke and stated he doesn’t have a problem with the fence, just wants to make sure he can see when backing out of the driveway. • General discussion on what is allowed, height & materials, also a discussion on shrubs planted in a setback area • Bryce Johnson had concerns about city liability if the fence was allowed and someone was hit backing out of the garage to the north A motion was made by Juan Garcia, seconded by Cole Bisgard to approve the approve the variance. On roll call, all nays, motion denied 4-0. Consider a variance request from Cory and Allison Millmier of 2510 SE Kettleridge Lane, to allow an existing 5-foot ornamental steel fence to remain within the required front yard setback. City Planner, Bill Mettee, presented an outline of the project, as shown in the staff report. The applicant is requesting a variance to allow a 5-foot-tall ornamental steel fence to remain on the property, placed within the required 20-foot front yard setback along SE Tallgrass Lane. The applicants spoke and explained that originally, a 4-foot fence was planned but later they instructed their contractor to change to a 5-foot fence. That change was not communicated to the city. Discussion as follows: • A general discussion followed regarding the city’s permitting process, and the fact that the fence is ornamental iron and is essentially “see-through” and does not block any sight lines • No other correspondence or feedback from neighbors has been received A motion was made by Juan Garcia, seconded by Emily Schulz to approve the variance. Roll call: Cole Bisgard – Yes Juan Garcia – Yes Bryce Johnson – No Emily Schultz – Yes Motion carried 3-1 Consider a variance request from Brandon and Sandra Fast, of 2515 SE Florence Drive, to allow a 5-foot ornamental steel fence to be placed within the required front yard setback. City Planner, Bill Mettee, presented an outline of the project, as shown in the staff report. The applicant is requesting a variance to allow a 5-foot ornamental steel fence on the property placed within the 20-foot front yard setback along SE Tallgrass Lane. The applicant spoke and explained that a 5-foot fence would be safer with their pool. Discussion as follows: • A general discussion followed including timing of notices for neighbors, what was appropriate for the area, city code requirements and that aesthetics should not be the sole reason for allowing a variance A motion was made by Juan Garcia, seconded by Cole Bisgard, to approve the variance. On roll call, all nays, motion denied 4-0. New Business: None The meeting was adjourned on a motion by Cole Bisgard and seconded by Bryce Johnson.
