AGENDA ITEM:Consideration of approval of resolution authorizing the sale of real estate
in accordance with Iowa Code 364.7 (2023)
FORMAT:Resolution
SYNOPSIS INCLUDING PRO & CON: The proposed sale to the City of Urbandale is being
undertaken pursuant to a 28E agreement entered into between the cities and approved by the City
of Waukee on January 16, 2023, by resolution.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Pursuant to paragraph 4.b of
the 28E Agreement the City of Urbandale proposed to purchase property for the sum of $60,000.
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: Staff recommends authorizing the sale of real estate in
accordance with Iowa Code 364.7 (2023)
RECOMMENDATION: Approve the resolution.

RESOLUTION 2023-
A RESOLUTION AUTHORIZING THE SALE OF REAL ESTATE IN ACCORDANCE
WITH IOWA CODE 364.7 (2023)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS, the City approved a 28E Agreement between the Cities of Waukee and Urbandale
regarding sanitary sewer project property interests on January 16, 2023; AND
WHEREAS, pursuant to paragraph 4.b. of that 28E Agreement the City of Urbandale proposed
to purchase property for the sum of $60,000 and the grant of certain easements to the City of
Waukee for the purpose of constructing and placing the NE Outfall Sewer infrastructure, the
property proposed to be purchased is legally described as follows:
Parcel 22-7 of Plat of Survey recorded in Book 2022 Page 24174, being a part of
Lot 2 in KAAS SUBDIVISION, an Official Plat, now included in and forming a
part of the City of Urbandale, Dallas County, Iowa
WHEREAS, the property consists of undevelopable property along Walnut Creek located within
the City of Urbandale; AND
WHEREAS, the City caused notice of a public hearing to be published in accordance with Iowa
Code 364.7 Code of Iowa (2013) concerning the sale of certain real estate owned by the City to
the City of Urbandale; AND
WHEREAS, the City of Waukee finds that the sale of the property as proposed is in the best
interest of the City.
BE IT THEREFORE RESOLVED that the City of Waukee hereby accepts the proposal by the
City of Urbandale to sell the property legally described as:
Parcel 22-7 of Plat of Survey recorded in Book 2022 Page 24174, being a part of
Lot 2 in KAAS SUBDIVISION, an Official Plat, now included in and forming a
part of the City of Urbandale, Dallas County, Iowa
NOW, THEREFORE, BE IT RESOLVED that the Mayor is hereby authorized to executed
any and all documents necessary to proceed with the sale and to convey the property described
above to the City of Urbandale.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 20th day of
November, 2023.
