Waukee (440 SE Alice’s Road)

SYNOPSIS INCLUDING PRO & CON: MLY Real Estate Inc requests approval of a site plan to
authorize the construction of a single-story building for a fast-food restaurant with a drive through.
The building is 2,880 square feet in area and 23.5 feet in height. The site includes a patio for dining to
the east of the building. A trash enclosure and small storage shed is proposed to the west of the
building. A monument sign is shown at the northeast corner of the site, along SE Alice’s Road.
One access will be provided into the site off of the private drive to the west. There will also be shared
accesses to the adjacent lots. Pedestrian connections are provided into the site from both the existing
trail along SE Alice’s Road and the private sidewalk to the west that will be constructed with this
project. A total of 44 parking spaces and 10 queuing spaces are required. They are providing 50
parking spaces and 15 queuing spaces.
The site will be serviced with private utilities that have been extended throughout the overall plat.
Storm water detention is provided with the large pond located to the southwest, within the overall
Waukee Towne Center development. The landscape plan meets the requirements of the Landscape and
Open Space Ordinance.
The elevations of the building are proposed to be constructed mainly of brick, EIFs, storefront system,
and Nichiha panels. The trash enclosure and storage shed will be constructed of Nichiha panels.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission
reviewed this project at the November 14, 2023, Commission Meeting and recommended
approval subject to remaining staff comments:
Item 6: Approval of a Site Plan for Freddy’s Waukee (440 SE Alice’s Road)
Bill Mettee, Planner, introduced the request for approval of a site plan for a commercial building, as
presented by applicant MLY Real Estate Inc., represented by James Rodemeyer, PE, of Bishop
Engineering.
The property address is 440 SE Alice’s Road and is generally located west of SE Alice’s Road and
south of SE Laurel Street, containing approximately 1.20 acres. The subject property was recently
platted as part of Waukee Towne Center Plat 5.
The project includes the construction of a single-story building for a fast-food restaurant with a drive
through. The building is 2,880 square feet in area and 23.5 feet in height. The site includes two drive-
through lanes for ordering and one drive-through for pick-up. A patio for dining is proposed along the

the gate for the trash enclosure will be a composite material. A photometric plan for the site lighting
has been submitted and complies with the requirements of the Site Plan Ordinance.
The comprehensive plan classifies the subject property as Neighborhood Commercial. The
Neighborhood Commercial classification provides a variety of uses that would serve the surrounding
neighborhoods and provide day-to-day goods and services for residents.
The site plan is in general conformance with the Site Plan Ordinance, Comprehensive Plan, and
Planned Development. Staff recommends approval of the site plan for Freddy’s Waukee, subject to
remaining staff comments.
Discussion as follows:
• Commissioner Broderick will be recusing himself from the vote
• Discussion of the building materials, specifically the Nichiha panels: Andy Kass spoke
of the panel characteristics, noting that it is very durable and is commonly used in
commercial projects
• Discussion of shared parking: Andy shared that the businesses included in Waukee
Towne Center that face SE Alice’s Road provide their own individual parking, but the
remainder of the development has cross access and parking easements to share the
overall shopping center area
Motion by Commissioner Beenken for approval of a Site Plan for Freddy’s Waukee, seconded by
Commissioner Lohse. Ayes: Koelker, Beenken, Lohse, Tessau. Recusals: Broderick. Nays: None.
Motion carried.
STAFF REVIEW AND COMMENT: Staff recommends approval of the site plan subject to
remaining staff comments.
RECOMMENDATION: Approve the resolution subject to remaining staff comments.

APPROVING THE SITE PLAN FOR FREDDY’S WAUKEE
(440 SE ALICE’S ROAD)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of
the Site Plan for Freddy’s Waukee, subject to remaining staff comments on November 14, 2023;
AND,
WHEREAS, the Site Plan for Freddy’s Waukee is in general conformance with §160 – Site and
Building Development Standards Ordinance of the Waukee Municipal Code; AND,
WHEREAS, the Site Plan for Freddy’s Waukee is in general conformance with §161 –
Landscaping and Open Space Ordinance of the Waukee Municipal Code; AND,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa on
this 20th day of November, 2023 that the Site Plan for Freddy’s Waukee is approved subject to
remaining staff comments.

STORM & SANITARY TELEVISING NOTES:

UTILITY CONFLICT NOTES:
1.UTILITY CONFLICTS MAY EXIST ACROSS THE SITE WITH NEW UTILITIES, GRADING, PAVING ETC. MOST UTILITY CONFLICTS HAVE BEEN CALLED OUT FOR
CONTRACTOR CONVENIENCE.
2.CONTRACTOR IS RESPONSIBLE FOR ALL UTILITY CONFLICTS THAT ARE EITHER CALLED OUT ON THE PLANS OR THAT CAN BE SEEN ON THE PLANS BETWEEN AN
EXISTING UTILITY AND PROPOSED CONSTRUCTION.
3.CONTRACTOR SHALL USE O-RING GASKET JOINTS FOR STORM SEWER AND SANITARY SEWER AT CROSSINGS WITH WATER WHERE STORM OR SANITARY
SEWER CROSSES OVER OR LESS THAN 18 INCHES BELOW WATER. O-RING GASKET JOINTS SHALL BE EXTENDED UNTIL WATER AND SEWER ARE AT LEAST 10

9.LABORATORY TESTS SHALL BE PERFORMED BY THE OWNER UNLESS OTHERWISE NOTED. THE CONTRACTOR SHALL PROVIDE SAMPLES OF MATERIAL REQUIRED FOR
LABORATORY TESTS AND TESTING IN ACCORDANCE WITH THE URBAN STANDARD SPECIFICATIONS FOR PUBLIC IMPROVEMENTS.
10.THE CONTRACTOR SHALL PROTECT ALL STRUCTURES NOT SHOWN AS REMOVALS ON THE PLANS.
11.THE CONTRACTOR SHALL OBTAIN ANY AND ALL NECESSARY PERMITS PRIOR TO ANY CONSTRUCTION. CONTRACTOR SHALL WORK WITH OWNER OR OWNERS
REPRESENTATIVE ON ALL REQUIRED STORM WATER DISCHARGE PERMITS FROM THE IOWA DEPARTMENT OF NATURAL RESOURCES AND THE CITY OF WAUKEE.
12.GRADING AND EROSION CONTROL SHALL BE DONE IN ACCORDANCE WITH THE APPROVED GRADING PLAN, SWPPP, NPDES DOCUMENTS, AND IOWA DEPARTMENT OF
NATURAL RESOURCES REQUIREMENTS.
13.THE CONTRACTOR SHALL PICK UP ANY DEBRIS SPILLED ONTO THE ADJACENT RIGHT OF WAY OR ABUTTING PROPERTIES AS THE RESULT OF CONSTRUCTION, AT THE
END OF EACH WORK DAY AND PRIOR TO A RAIN EVENT.
14.THE CONTRACTOR IS RESPONSIBLE FOR THE PROMPT REMOVAL OF ALL MUD THAT HAS BEEN TRACKED OR WASHED UNTO ADJACENT PROPERTY OR RIGHT OF WAY
UNTIL SUCH TIME THAT PERMANENT VEGETATION HAS BEEN ESTABLISHED.
15.DISPOSE OF ALL EXCESS MATERIALS AND TRASH IN ACCORDANCE WITH FEDERAL, STATE, AND LOCAL REQUIREMENTS. PROVIDE WASTE AREAS OR DISPOSAL SITES
