HomeMy WebLinkAbout2023-12-04 I02 Truck Routes_INTRO, 1ST READAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: December 4, 2023 AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 66.05 Waukee Municipal Code, Traffic Regulations of the City of Waukee, Iowa by amending Section 66.05 “Truck Routes” as specified [introduction; first reading] FORMAT:Ordinance SYNOPSIS INCLUDING PRO & CON: Due to the extension of existing streets designated as truck routes and the addition of new streets intended to be truck routes, staff are proposing these additional streets are designated as “Truck Routes” to better manage large vehicle traffic within established residential and commercial areas. Further, the Governor of Iowa signed SF2376 into law on May 23, 2022 which created a new All Systems Annual Overweight Permit statewide on all state, county and city streets categorized as a truck route. Counties and Cities are required to validate all truck routes for this permit by July 1, 2025. This amendment brings Waukee into compliance with this state requirement. AN ORDINANCE TO AMEND CHAPTER 66, LOAD AND WEIGHT RESTRICTIONS, CITY OF WAUKEE, IOWA MUNICIPAL CODE, BY AMENDING SECTION 66.05 TRUCK ROUTES AS SPECIFIED BELOW WHEREAS, the City of Waukee has determined that certain public streets should be added to the truck route ordinance. BE IT THEREFORE ORDAINED by the City Council of the City of Waukee: Section 1. Waukee Municipal Code, Chapter 66, Section 66.05 Truck Routes should be and the same is hereby repealed and enacted in lieu thereof is as follows: §66.05 Truck Routes. Truck route regulations are established as follows: 1.Truck Routes Designated. Every motor vehicle weighing five tons or more, when loaded or empty, having no fixed terminal within the City or making no scheduled or definite stops within the City for the purpose of loading or unloading or commercial stop, shall travel over or upon the following streets within the City and none other: (Code of Iowa, Sec. 321.473) A.6th Street (R-22) between W Hickman Road and the south city limits. B.10th Street/NW 10th Street between the north City limits and SE University Avenue. C.NE/SE Alice’s Road between SE University Avenue and the north City limits. D.SE L.A. Grant Parkway between SE University Avenue and SE Ashworth Road. E.SE University Avenue between SE L.A. Grant Parkway and the east City limits. F.Ashworth Road/SE Ashworth Road between the west City limits and the east City limits. G.W/E Hickman Road (U.S. Highway 6) between the west City limits and the east City limits. H.N Warrior Lane between Hickman Road and the north City limits. I.NE Douglas Parkway between the west City limits and the east City limits. J.Grand Prairie Parkway between SE University Avenue and I-80. K.SE Westown Parkway between Ute Avenue (R-22) and the east City limits. L.SE Waco Place between SE University Avenue and SE Ashworth Road. M.NW 20th Street between W Hickman Road (U.S. Highway 6) and the north City limits. 2 N.NW 30th Street between W Hickman Road (U.S. Highway 6) and the north City limits. O.S Warrior Lane between Hickman Road and SE Ashworth Drive. P.SE Ashworth Drive between S Warrior Lane and SE University Avenue. Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
