AGENDA ITEM: Consideration of approval of a resolution approving a site plan for The Nest
Pediatric Dentistry Building Addition (1250 SE University Avenue)

SYNOPSIS INCLUDING PRO & CON: Artemis Consortium, LLC requests approval of a site plan
for a building addition to the existing The Nest Dentistry office located south of SE University Avenue
and west of SE Waco Place / 98th Street. The building addition is approximately 2,471-square feet in
area and 17-feet in height. The project will add 18 parking spaces. The building will be constructed
primarily of stone, storefront system and Nichiha panels. The addition will match the existing
structure.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission
reviewed this project at the January 9, 2024, Commission Meeting and recommended approval:
Item 6: Approval of a Site Plan for The Nest Pediatric Dentistry Building Addition (1250 SE

Melissa DeBoer, Planning Coordinator, introduced the request for approval of a site plan for a building
addition to an existing dentistry office, as requested by Artemis Consortium, LLC, represented by
Monte Applegate, PLA, Snyder & Associates.
The property is generally located south of SE University Avenue and west of SE Waco Place/98th
Street, containing approximately one (1) acre.
The project includes the construction of an addition to an existing dental office building. The building
is proposed to be approximately 2,471 square feet in area. The overall building square footage with
the addition will be approximately 5,951 square feet. The main entrance to the building is located on
the north side, facing SE University Avenue. The addition will have an access door on the south side
of the building. The trash enclosure will remain at the southeast corner of the site and the monume nt
sign will remain at the northeast corner of the site, along SE University Avenue.
There are two accesses into this site from the public street, SE Bishop Drive. One access is located on
the west side of the site and the other access is located on the south side of the site. There is also a
shared access drive with the property to the east that can be accessed from SE University Avenue.
A total of 24 parking spaces are required for this facility. The total amount of parking proposed is 42
spaces including two (2) accessible stalls. Eighteen (18) additional spaces are proposed with this site
plan. The site plan also shows the four (4) bicycle parking spaces to remain along the north side of the
building. The proposed site plan meets the parking requirements of the ordinance.

Five-foot-wide sidewalks have been installed along SE Bishop Drive on the south, SE Bishop Drive on
the west, and SE University Avenue on the north. Sidewalks were also installed interior to the site to
provide pedestrian connections from the parking lot to the building. The applicant is adding an
additional sidewalk interior to the site to provide access to the addition.
This site is serviced with all public utilities and will be extended as needed to service the building
addition. Stormwater detention will continue to be provided with a detention basin located at the south
side of the site.
A minimum of 15% of the project area is required to be open space. The total amount of open space
proposed is 45.25%. The landscape plan meets the requirements of the Landscape and Open Space
Ordinance and the Kettlestone Design Guidelines. The elevations of the building are proposed to be
constructed of stone, Nichiha panels, and aluminum storefront system. The addition will match the
existing building. The applicant has stated that several existing light fixtures will be relocated on the
site. All lighting fixtures were approved with the original site plan. The lighting plan meets the
lighting requirements of the Site Plan Ordinance. The comprehensive plan classifies the subject
property as Community Commercial. This classification provides a variety of uses that would serve
the community and are located along minor or major arterials.
The site plan is in general conformance with the Site Plan Ordinance and Comprehensive Plan. Staff
recommends approval of the site plan for The Nest Pediatric Dentistry Building Addition.
Discussion as follows:
• Commissioner Streit asked about if there was always a plan to expand; Melissa responded yes,
the request closely matches the original site plan
Motion by Commissioner Broderick for approval of a site plan for The Nest Pediatric Dentistry
Building Addition, seconded by Commissioner Lohse. Ayes: Beenken, Koelker, Broderick, Streit,
Tessau, Lohse and Bankole. Nays: None. Motion carried.
STAFF REVIEW AND COMMENT: Staff recommends approval of the site plan.
RECOMMENDATION: Approve the resolution.

ADDITION (1250 SE UNIVERSITY AVENUE)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of
the Site Plan for The Nest Pediatric Dentistry Building Addition on January 9, 2024; AND,
WHEREAS, the Site Plan for The Nest Pediatric Dentistry Building is in general conformance
with §160 – Site and Building Development Standards Ordinance of the Waukee Municipal
Code; AND,
WHEREAS, the Site Plan for The Nest Pediatric Dentistry Building is in general conformance
with §161 – Landscaping and Open Space Ordinance of the Waukee Municipal Code; AND,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa on
this 15th day of January, 2024 that the Site Plan for The Nest Pediatric Dentistry Building is
approved.

PROJECT DESCRIPTION
The project includes the construction of an addition to an existing dental office building. The building is
proposed to be approximately 2,471 square feet in area. The overall building square footage with the addition
will be approximately 5,951 square feet. The main entrance to the building is located on the north side, facing
SE University Avenue. The addition will have an access door on the south side of the building.
The trash enclosure will remain at the southeast corner of the site and the monument sign will remain at the
northeast corner of the site, along SE University Avenue.
ACCESS AND PARKING
There are two accesses into this site from the public street, SE Bishop Drive. One access is located on the
west side of the site and the other access is located on the south side of the site. There is also a shared access
drive with the property to the east that can be accessed from SE University Avenue.
A total of 24 parking spaces are required for this facility. The total amount of parking proposed is 42 spaces
including 2 accessible stalls. Eighteen (18) additional spaces are proposed with this site plan. The site plan also
shows the 4 bicycle parking spaces to remain along the north side of the building. The proposed site plan
meets the parking requirements of the ordinance.

SIDEWALKS/TRAILS
Five foot wide sidewalks have been installed along SE Bishop Drive on the south, SE Bishop Drive on the west,
and SE University Avenue on the north. Sidewalks were also installed interior to the site in order to provide
pedestrian connections from the parking lot to the building. The applicant is adding an additional sidewalk
interior to the site to provide access to the addition.
UTILITIES
This site is serviced with all public utilities and those utilities will be extended as needed to service the building
addition. Storm water detention will continue to be provided with a detention basin located at the south side
of the site.
LANDSCAPING & OPEN SPACE
A minimum of 15% of the project area is required to be open space. The total amount of open space
proposed is 45.25%. The landscape plan meets the requirements of the Landscape and Open Space Ordinance
and the Kettlestone Design Guidelines.

1.NOTIFY UTILITY PROVIDERS PRIOR TO BEGINNING ANY CONSTRUCTION
ACTIVITIES AND COORDINATE WITH UTILITY PROVIDERS AS NECESSARY
DURING CONSTRUCTION. CONTRACTOR IS RESPONSIBLE FOR

BACKFILL WITH SUITABLE MATERIAL AND COMPACT TO 95% MAXIMUM
DENSITY.
7.IN THE EVENT OF A DISCREPANCY BETWEEN THE QUANTITY ESTIMATES
AND THE DETAILED PLANS, THE DETAILED PLANS SHALL GOVERN.
8.ALL FIELD TILES ENCOUNTERED DURING CONSTRUCTION SHALL BE
RECONNECTED AND NOTED ACCORDINGLY ON THE AS-BUILT
DOCUMENTS.
9.DIMENSIONS, BUILDING LOCATION, UTILITIES AND GRADING OF THIS SITE
ARE BASED ON AVAILABLE INFORMATION AT THE TIME OF DESIGN.
DEVIATIONS MAY BE NECESSARY IN THE FIELD. ANY SUCH CHANGES OR
CONFLICTS BETWEEN THIS PLAN AND FIELD CONDITIONS ARE TO BE
REPORTED TO THE ARCHITECT/ENGINEER PRIOR TO STARTING
CONSTRUCTION. THE CONTRACTOR SHALL BE RESPONSIBLE FOR
LAYOUT VERIFICATION OF ALL SITE IMPROVEMENTS PRIOR TO
CONSTRUCTION.
10.CONTRACTOR TO LOAD AND TRANSPORT ALL MATERIALS CONSIDERED
TO BE UNDESIRABLE TO BE INCORPORATED INTO THE PROJECT TO AN
APPROVED OFF-SITE WASTE SITE.
11.CONTRACTOR TO STRIP AND STOCKPILE TOPSOIL FROM ALL AREAS TO
BE CUT OR FILLED. RESPREAD TO MINIMUM 8" DEPTH TO FINISH
GRADES.
12.ALL PROPOSED CONTOURS AND SPOT ELEVATIONS SHOWN ARE
FINISHED GRADES AND/OR TOP OF PAVING SLAB (GUTTER), UNLESS
OTHERWISE NOTED.
13.THE CONTRACTOR IS RESPONSIBLE FOR CLEANING DIRT AND DEBRIS
FROM NEIGHBORING STREETS, DRIVEWAYS, AND SIDEWALKS CAUSED
BY CONSTRUCTION ACTIVITIES AT THE END OF EACH WORK DAY AND
PRIOR TO A RAIN EVENT.
14.THE ADJUSTMENT OF ANY EXISTING UTILITY APPURTENANCES TO FINAL

AND ANY OTHER FRANCHISE UTILITY SERVICES WITH UTILITY SERVICE

17.CONTRACTOR TO VERIFY ALL UTILITY CROSSINGS AND MAINTAIN

POLLUTION PREVENTION NOTES
A.POLLUTION PREVENTION AND EROSION PROTECTION
1. CODE COMPLIANCE: THE CONTRACTOR IS RESPONSIBLE FOR COMPLIANCE WITH
ALL POTENTIAL POLLUTION AND SOIL EROSION CONTROL REQUIREMENTS OF THE
IOWA CODE, THE U.S. CLEAN WATER ACT AND ANY LOCAL ORDINANCES. THE
CONTRACTOR SHALL TAKE ALL NECESSARY STEPS TO PROTECT AGAINST
EROSION AND POLLUTION FROM THIS PROJECT SITE AND ALL OFF-SITE BORROW
OR DEPOSIT AREAS DURING PERFORMANCE OR AS A RESULT OF PERFORMANCE.
2.DAMAGE CLAIMS: THE CONTRACTOR WILL HOLD THE OWNER AND ARCHITECT /
ENGINEER HARMLESS FROM ANY AND ALL CLAIMS OF ANY TYPE WHATSOEVER
RESULTING FROM DAMAGES TO ADJOINING PUBLIC OR PRIVATE PROPERTY,
INCLUDING REASONABLE ATTORNEY FEES INCURRED TO OWNER. FURTHER, IF
THE CONTRACTOR FAILS TO TAKE NECESSARY STEPS TO PROMPTLY REMOVE
EARTH SEDIMENTATION OR DEBRIS WHICH COMES ONTO ADJOINING PUBLIC OR
PRIVATE PROPERTY, THE OWNER MAY, BUT NEED NOT, REMOVE SUCH ITEMS AND
DEDUCT THE COST THEREOF FROM AMOUNTS DUE TO THE CONTRACTOR.
B.POLLUTION PREVENTION PLAN
1. THERE IS NOT A SWPPP OR GENERAL PERMIT #2 PERMIT ON THIS PROJECT. THE
CONTRACTOR IS RESPONSIBLE FOR COMPLIANCE WITH ALL EROSION CONTROL
LAW REQUIREMENTS, INCLUDING, BUT NOT LIMITED TO, THE FOLLOWING BMP'S
UNLESS INFEASIBLE OR NOT APPLICABLE:
a.INSTALL PERIMETER AND FINAL SEDIMENT CONTROL MEASURES SUCH AS SILT
BARRIERS, DITCH CHECKS, DIVERSION BERMS, OR SEDIMENTATION BASINS
DOWNSTREAM OF SOIL DISTURBING ACTIVITIES PRIOR TO SITE CLEARING AND
GRADING OPERATIONS.
b.PRESERVE EXISTING VEGETATION IN AREAS NOT NEEDED FOR CONSTRUCTION
AND LIMIT TO A MINIMUM THE TOTAL AREA DISTURBED BY CONSTRUCTION
OPERATIONS AT ANY TIME.
c.MAINTAIN ALL TEMPORARY AND PERMANENT EROSION CONTROL MEASURES IN
WORKING ORDER, INCLUDING CLEANING, REPAIRING, REPLACEMENT, AND
SEDIMENT REMOVAL THROUGHOUT THE PERMIT PERIOD. CLEAN OR REPLACE
SILT CONTROL DEVICES WHEN THE MEASURES HAVE LOST 50% OF THEIR
ORIGINAL CAPACITY.
d.PREVENT ACCUMULATION OF EARTH AND DEBRIS FROM CONSTRUCTION
ACTIVITIES ON ADJOINING PUBLIC OR PRIVATE PROPERTIES, INCLUDING
STREETS, DRIVEWAYS, SIDEWALKS, DRAINAGEWAYS, OR UNDERGROUND
SEWERS. REMOVE ANY ACCUMULATION OF EARTH OR DEBRIS IMMEDIATELY
AND TAKE REMEDIAL ACTIONS FOR FUTURE PREVENTION.
e.INSTALL NECESSARY CONTROL MEASURES SUCH AS SILT BARRIERS, EROSION
CONTROL MATS, MULCH, DITCH CHECKS OR RIPRAP AS SOON AS AREAS REACH

SOD) ON ALL DISTURBED AREAS, EXCEPT WHERE PAVEMENT, BUILDINGS OR
OTHER IMPROVEMENTS ARE LOCATED.
g.STABILIZE UNDEVELOPED, DISTURBED AREAS WITH MULCH, TEMPORARY SEED
MIX, PERMANENT SEED MIX, SOD, OR PAVEMENT IMMEDIATELY AS SOON AS
POSSIBLE UPON COMPLETION OR DELAY OF GRADING OPERATIONS. INITIATE
STABILIZATION MEASURES IMMEDIATELY AFTER CONSTRUCTION ACTIVITY IS
