SYNOPSIS INCLUDING PRO & CON: The project includes all materials, equipment,
transportation and labor necessary to widen SE Legacy Pointe Blvd to create a boulevard section
including PCC pavement, PCC sidewalk and pedestrian ramps, and traffic signal modifications at
the intersection. Project items include subgrade preparation and treatment, PCC roadway paving
and sidewalk/trail ramp paving, pavement markings, traffic signalization, traffic control and
construction of median.
This project has a total project budget of $350,000 in the approved FY 2024-28 CIP and another
$300,000 in the draft FY 2025-29 CIP for a total budget of $650,000. The project schedule
entails taking bids on March 7, 2024 and reporting of bids at the regular scheduled City Council
meeting on March 18, 2024.

RESOLUTION ORDERING CONSTRUCTION OF THE
HICKMAN ROAD (US 6) & 161ST STREET/SE LEGACY
POINTE BLVD INTERSECTION IMPROVEMENTS - PHASE 2,
RATIFYING, CONFIRMING AND APPROVING DEADLINE
FOR SUBMISSION OF BIDS AND FIXING A DATE FOR
HEARING THEREFOR
WHEREAS, it is deemed advisable and necessary to construct certain public improvements
as a joint project with the City of Clive described in general as the Hickman Road (US 6) & 161st
Street/SE Legacy Pointe Blvd Intersection Improvements - Phase 2; and
WHEREAS, the City of Clive will serve as the lead agency for the Project and will enter
into the construction contract for the Project; and
WHEREAS, the City of Clive has caused to be prepared plans, specifications and form of
contract, together with estimate of cost, which are now on file in the office of the Waukee City
Clerk for public inspection, for the construction of the public improvements; and
WHEREAS, the plans, specifications and form of contract are deemed suitable for the
making of the public improvements; and
WHEREAS, final grades have been established by ordinance, consistent with the plans for
all street improvements included in the proposed construction; and
WHEREAS, before the plans, specifications, form of contract and estimate of cost may be
adopted, and a contract for the construction of the public improvements is entered into, it is
necessary, pursuant to Chapter 26, Code of Iowa, to hold a public hearing and to advertise for bids;
and
WHEREAS, on or about February 9 and February 13, 2024, a Notice to Bidders was posted
on a relevant contractor plan room service with statewide circulation and a relevant construction
lead generating service with statewide circulation establishing 2:00 P.M. on March 7, 2024 as the
deadline for submission of bids; and
WHEREAS, on February 14, 2024, the City Clerk posted the Notice to Bidders on the City
of Waukee’s website, which is an internet site sponsored by the City of Waukee:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WAUKEE, STATE OF IOWA:
Section 1.That it is hereby determined that it is necessary and advisable to construct certain
public improvements described in general as the Hickman Road (US 6) & 161st Street/SE Legacy
Pointe Blvd Intersection Improvements - Phase 2, in the manner set forth in the plans and
specifications and form of contract, above referred to, the cost thereof to be paid in accordance
with the provisions as set out in the posted Notice to Bidders and published Notice of Public
Hearing; the public improvements being more generally described as follows:
This project includes all materials, equipment, transportation and labor necessary
to widen Legacy Pointe Blvd to create a boulevard section including PCC
pavement, PCC sidewalk and pedestrian ramps, and traffic signal modifications at
the intersection. Project items include subgrade preparation and treatment, PCC
roadway paving and sidewalk/trail ramp paving, pavement markings, traffic
signalization, traffic control and construction of median. Specific project location
along with the kind and approximate quantity of materials to be used shall be as set
forth in the Plans and Specifications.
Section 2.That the amount of the bid security to accompany each bid shall be in an amount
which shall conform to the provisions of the notice to bidders approved as a part of the
specifications.
Section 3.That the actions of the City of Clive in posting a Notice to Bidders once in a
relevant contractor plan room service with statewide circulation and a relevant construction lead
generating service with statewide circulation, are hereby ratified, confirmed, and approved.
Section 4.That the actions of the City Clerk of the City of Waukee in posting the Notice
to Bidders on an internet site sponsored by either the City or a statewide association that represents
the City, are hereby ratified, confirmed, and approved.
Section 5. That the actions of the City of Clive in setting a date for the receipt of bids
before 2:00 P.M. on March 7, 2024 are hereby ratified, confirmed, and approved.
Section 6.That the City Council hereby delegates to the designated representative for the
City of Clive, as determined by the City Council of the City of Clive, the duty of receiving, opening
and tabulating bids for construction of the Project. Bids shall be received and opened as provided
in the public notice and the results of the bids shall be considered at the meeting of this Council
on March 18, 2024, at 5:30 P.M.
Section 7. That the City Clerk be and is hereby directed to publish notice of hearing once
in a legal newspaper, printed wholly in the English language, published at least once weekly and
having general circulation in this City. Publication shall be not less than four clear days nor more
than twenty days prior to the date hereinafter fixed as the date for a public hearing on the plans,
specifications, form of contract and estimate of costs for the project, the hearing to be at 5:30 P.M.
on March 18, 2024.

NOTICE TO BIDDERS AND NOTICE OF PUBLIC HEARING
CITY OF CLIVE AND CITY OF WAUKEE
HICKMAN ROAD (US 6) & 161ST STREET/SE LEGACY POINTE BLVD INTERSECTION IMPROVEMENTS –
PHASE 2
Time and Place for Filing Sealed Proposals. Sealed bids for the work comprising each
improvement as stated below must be filed before 2:00 p.m. on March 7th, 2024 in the office of the
City Clerk, Clive City Hall, 1900 NW 114th Street, Clive, Iowa 50325-7077
Time and Place Sealed Proposals Will be Opened and Considered. Sealed proposals will be
opened and bids tabulated at 2:00 p.m. on March 7th, 2024, in the Council Chambers of the Clive
City Hall, 1900 NW 114th Street, Clive, Iowa, for consideration by the Clive City Council at its
meeting at 6:00 p.m. on March 14th, 2024 in the Council Chambers of Clive City Hall, 1900 NW
114th Street, Clive, Iowa. Bids will be presented for consideration by the Waukee City Council at
its meeting at 5:30 p.m. on March 18th, 2024 in the Council Chambers of the Waukee City Hall, at
230 Hickman Road, Waukee, Iowa. The City of Clive and City of Waukee reserve the right to
reject any and all bids.
The City of Clive in accordance with Title VI of the Civil Rights Act of 1964, Stat. 252, 42 U.S.C.
2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation,
Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally assisted programs of
the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it
will affirmatively insure that in any contract entered into pursuant to this advertisement, minority
business enterprises will be afforded full opportunity to submit bids in response to this invitation
and will not be discriminated against on the grounds of race, color, national origin, sex, age, or
disability in consideration for award.
Time for Commencement and Completion of Work. Work on the improvements shall
commence on or before the late start date of May 15, 2024. Work shall be substantially completed
on or before August 15, 2024, including all pavement/sidewalk/median work and all underground
signal (pole foundations, conduits, and handholes) work. Signals shall be activated on or before
December 31, 2024. Liquidated damages for noncompliance with said completion provisions
will be assessed at the rate of One Thousand Dollars ($1,000.00) for each calendar day thereafter
that the work remains incomplete.
Bid Security. Each bidder shall accompany its bid with bid security as defined in Section 26.8
of the Iowa Code and as outlined in the Instruction to Bidders in an amount equal to Ten (10)
percent of the total bid amount.
Contract Documents. Copies of the contract documents are available from the Public Works
Department, may be examined at the Public Works Facility, 2123 NW 111th Street, Clive, Iowa or
received electronically by emailing Jim Hagelie (jhagelie@cityofclive.com). Copies shall be
available at no cost. Project documents will be on file for inspection at the following offices after
issuance date:

Public Hearing on Proposed Contract Documents and Estimated Costs for Improvement. A
public hearing will be held by the Clive City Council on the proposed contract documents (plans,
specifications and form of contract) and estimated cost for the improvements, as bid by the selected
bidder, at its meeting at 6:00 pm on March 14th, 2024, in said Council Chambers of the City Hall,
1900 NW 114th Street, Clive, Iowa.
A public hearing will be held by the Waukee City Council on the proposed contract documents
(plans, specifications and form of contract) and estimated cost for the improvements, as bid by the
selected bidder, at its meeting at 5:30 pm on March 18th, 2024, in said Council Chambers of the
City Hall, 230 Hickman Road, Waukee, Iowa. In accordance with Iowa Code Sections 21.4(1)(b)
and 21.8, this meeting of the Waukee City Council will be conducted with two different options for
public participation: 1) Members of the public wishing to attend in person may do so in the
Council Chambers at Waukee City Hall. 2) Members of the public wishing to participate

NTB-3 Notice to Bidders
Preference of Products and Labor. Preference shall be given to domestic construction materials
by the contractor, subcontractors, material, men and suppliers in performance of the contract and,
further, by virtue of statutory authority, preference will be given to products and provisions grown
and coal produced within the State of Iowa, and to Iowa domestic labor, to the extent lawfully
required under Iowa statutes.
Resident Bidder Preference Law. Iowa Code 73A.21 outlines the reciprocal resident bidder and
labor force preference statute. The Iowa Department of Labor (DOL) has adopted administrative
rules to enforce this law. Failure to submit a fully completed Bidder Status Form with the bid may
result in the bid being deemed nonresponsive and rejected.
Sales Tax. The bidder shall not include sales tax in the bid. The City of Clive will distribute tax
exemption certificates and authorization letters to the Contractor and all Subcontractors who are
identified. The Contractor and Subcontractors may make copies of the tax exemption certificates
and provide a copy to each supplier providing construction materials. These tax exemption
certificates and authorization letters are applicable only for this specific project under the Contract.
