MEETING DATE: March 4, 2024
AGENDA ITEM: Consideration of approval of a Motion to set a Public Hearing Date of
March 18, 2024, as the date of public hearing concerning the vacation
and disposal of public property pursuant to Iowa Code Sections 354.23
and 364.7 (2024) [Songbird Park]
FORMAT: Motion
SYNOPSIS INCLUDING PRO & CON: In 2003, the City of Waukee agreed to dispose
of a small portion of Songbird Park and deed it over to the property
owner at 1070 1st Street Place in exchange for an ingress/egress easement
across the owner’s property to allow pedestrian access to Songbird Park.
The deed was filed in 2003, however, Dallas County never created the
parcel due to errors on the survey provided with the deed. It was not until
recently when the property owner began estate planning that they
realized the parcel was never officially created or deeded to them. This
process will correct the errors made in 2003.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:

STAFF REVIEW AND COMMENT: Staff would recommend a public hearing date be set for
March 18, 2024.
RECOMMENDATION: Approve the motion.
