HomeMy WebLinkAbout2024-05-06 G03 Habitat for Humanity Development Agreement and Option to Purchase_PHAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: May 6, 2024 AGENDA ITEM:On a proposal to enter into an Option Agreement and a Development Agreement with Greater Des Moines Habitat for Humanity, Inc. related to a project within the North Waukee Residential Urban Renewal Area, which includes the potential sale of the City’s interest in real property FORMAT:Public Hearing SYNOPSIS INCLUDING PRO & CON: Habitat for Humanity of Greater Des Moines has proposed developing 48 affordable townhome units on the northern half of the parcel near Douglas Parkway and North Warrior Ln. The negotiated development agreement lays out all of the requirements for the City and for the developer. Should Habitat abide by the terms in the development agreement, the option to purchase would allow Habitat to purchase this property for $1. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: The City purchased the entire 13.6 acre parcel for $900,500. This resolution relates to the northern half and should Habitat for Humanity abide by the terms of the development agreement, the City has agreed to allow them to purchase that land for $1. The amended urban renewal plan allows the City of Waukee to provide up to $500,000 in tax increment rebate incentive for this project. PURSUANT TO A PROPOSED OPTION AGREEMENT AND A PROPOSED DEVELOPMENT AGREEMENT, AND THE HEARING THEREON PUBLIC NOTICE is hereby given that the Council of the City of Waukee in the State of Iowa, will hold a public hearing before itself at its meeting that commences at 5:30 P.M. on May 6, 2024, in the City Office, 230 West Hickman Road, Waukee, Iowa 50263, at which meeting the Council proposes to take action on the proposal to enter into an Option Agreement and a Development Agreement (collectively the "Agreement") with Greater Des Moines Habitat for Humanity, Inc. ("Habitat"), and the proposal to convey certain real property (the "Property") located within the North Waukee Residential Urban Renewal Area to Habitat, pursuant to the terms and conditions of the Agreement. The Agreement proposes that the City would sell the Property to Habitat for $1.00 and in consideration of Habitat’s other obligations set forth in the Agreement, including that the Property will be used to construct 48 townhome-style residential units on the Property to be sold to low and moderate income families (“Project”), subject to the detailed terms and conditions set forth in the Agreement. The Agreement further proposes that the City would provide annual tax increment rebates derived from the Project to Habitat up to an aggregate amount not to exceed $500,000, subject to terms and conditions in the Agreement. Copies of the Option Agreement and Development Agreement are on file for public inspection during regular business hours in the office of the City Clerk, City Hall, City of Waukee, Iowa. The proposal may be subject to additional conditions as may be stated either in the Agreement, the resolution of the City Council, or documents entered into between the parties. At the above meeting, the Council shall receive oral or written objections from any resident or property owner to the proposal to enter into the Agreement with Habitat. After all objections have been received and considered, the Council may at this meeting or at any adjournment thereof, take additional action to approve the Agreement or to modify the Agreement, or may abandon the proposal to authorize said Agreement.
