STAFF REVIEW AND COMMENT: The City of Clive has reviewed the public improvements for
the Meredith Drive/Warrior Lane HMA Overlay Project and find it in substantial accordance with the
plans and specifications for the project.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2024-
RESOLUTION ACCEPTING THE MEREDITH
DRIVE/WARRIOR LANE HMA OVERLAY PROJECT
WHEREAS, on the 24th day of June, 2021, the Mayor and Clerk of the City of Clive, Iowa,
as lead agency under a joint project with the City of Waukee, entered into a construction contract
with Des Moines Asphalt & Paving of Ankeny, IA, for the construction of certain public
improvements generally described as the Meredith Drive/Warrior Lane HMA Overlay Project; and
WHEREAS, the contractor has fully completed the construction of the public
improvements in accordance with the terms and conditions of the contract and plans and
specifications, as reported by staff and City Council of the City of Clive, Iowa, on December 9,
2021.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WAUKEE, STATE OF IOWA:
Section 1.That the report of the City of Clive be and the same is hereby approved and
adopted, and the public improvements are hereby approved and accepted as having been fully
completed in accordance with the plans, specifications and form of contract and the total final
construction cost thereof is hereby determined to be $976,240.38, as shown in the final pay request
of the contractor and approved by the City of Clive on or about January 13, 2022.

RESOLUTION ACCEPTING WORK FOR THE
MEREDITH DRIVE/WARRIOR LANE HMA OVERLAY PROJECT
WHEREAS, the City entered into an agreement in connection with the Meredith
Drive/Warrior Lane HMA Overlay Project (the "Project"); and
WHEREAS, the work has now been completed under the Project; and
WHEREAS, in the judgment of the City Council, the work appears to meet the
requirements of the plans and specifications for the Project, and City staff has recommended the
acceptance of such Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CLIVE, IOWA:
The work on the Project is hereby accepted, and except for the
remaining retainage to be held by the City for not less than thirty
30) days after acceptance of the Project, the amount due to the
contractor is hereby ordered paid from available funds from which
payment for the Project may be made.
