AGENDA ITEM: Consideration of approval of a resolution consenting to an amendment to the
declaration of covenants, conditions, and restrictions [Springcrest Townhomes
Plat 2]
FORMAT: Consent Agenda
SYNOPSIS INCLUDING PRO & CON: The developer of Springcrest Townhomes Plat 2 proposes
to amend the existing covenants for the development that we originally filed
in 2022 when the plat was recorded. The purpose of the proposed amendment
is to amend the weight restrictions for dogs allowed within the development.
The city does not regulate pets based on weight.

STAFF REVIEW AND COMMENT: Staff has reviewed the proposed amendment and has
determined that it is not in conflict with any city ordinance or policy.
RECOMMENDATION: Approve the resolution

RESOLUTION 2024-
APPROVING CONSENT TO AN AMENDMENT TO THE DECLARATION OF
COVENANTS, CONDITIONS & RESTRICTIONS FOR SPRINGCREST
TOWNHOMES PLAT 2
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Springcrest Townhomes Waukee 2, LLC, caused to be filed a Declaration of
Covenants, Conditions & Restrictions (“Declaration”) that was recorded in the office of the
Dallas County Recorder on October 24, 2022 in Book 2022, Page 22355; AND,
WHEREAS, the Declaration included a provision which stipulated that any amendments to the
Declaration shall be approved by the City of Waukee prior to filing said amendment with the
Dallas County Recorder, AND,
WHEREAS, Springcrest Townhomes Waukee 2, LLC, is requesting approval of Consent to an
Amendment to the Declaration of Covenants, Conditions & Restrictions for Springcrest
Townhomes Plat 2 to amend weight restrictions for pets within the development.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
3rd day of June 2024, that it hereby approves the Consent to an Amendment to the Declaration of
Covenants, Conditions & Restrictions for Spring Crest Townhomes Plat 2.
