[Ute Avenue & Ashworth Road Intersection Improvement Project] FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: The original agreement ($396,900) was approved by City Council on August 3, 2020. Supplemental Agreement No. 1 ($48,300) was approved by City Council on June 21, 2021. Supplemental Agreement No. 2 ($26,100) was approved by City Council on September 7, 2021. Supplemental Agreement No. 3 covers additional construction services provided by the consultant due to the contractor exceeding the contract completion date by 206 calendar days. Staff have included the cost of supplemental agreement no. 3 in the damages to be assessed to the contractor as a direct result of the project being completed past the contract completion date. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Amendment No. 3 is for an additional amount not to exceed $9,800.00. This amendment will bring the new contract amount to $481,100.00. [UTE AVENUE & ASHWORTH ROAD INTERSECTION IMPROVEMENT PROJECT] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County; AND, WHEREAS, on August 3, 2020 (Resolution #2020-292), the Waukee City Council approved an agreement with Snyder & Associates for Professional Consulting Services related to the Ute Avenue and Ashworth Road Intersection Improvement Project; AND, WHEREAS, on June 21, 2021 (Resolution #2021-274) and September 7, 2021 (Resolution #2022-373), the Waukee City Council approved Supplemental Agreements No. 1 and 2 respectively with Snyder & Associates for Professional Consulting Services related to the Ute Avenue and Ashworth Road Intersection Improvement Project; AND, WHEREAS, Supplemental Agreement No. 3 covers additional construction services provided by the consultant due to the contractor exceeding the contract completion date by 206 calendar days. GENERAL The Contractor exceeded the construction completion date leading to additional construction progress meetings, payment applications, and general construction administration for the project. To date, the Contractor has exceeded the completion date by 206 calendar days. The current Consultant construction administration budget is not able to absorb the additional effort. This supplemental agreement request covers the additional construction service efforts. II. CONSTRUCTION SERVICES The Consultant will perform the following tasks related to construction administration. A. Attend on-site construction meetings as necessary beyond construction contract substantial completion. B. Create and process partial payment requests and change orders beyond construction contract substantial completion. C.
