APPROVING AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES
AMENDMENT NO.2 WITH FOTH INFRASTRUCTURE AND ENVIRONMENT, LLC
[KETTLESTONE BURT PROPERTY ENVIRONMENTAL SERVICES PROJECT]
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, 10WA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City approved the original Professional Consulting Services Agreement with
Foth Infrastructure and Environment, LLC for the Kettlestone Burt Property Environmental
Services on March 7, 2022 (RES 2022-079); AND,
WHEREAS, the City approved the Amendment No. 1 to the Professional Consulting Services
Agreement with Foth Infrastructure and Environment, LLC for the Kettlestone Burt Property
Environmental Services on June 6, 2022 (RES 2022-232); AND,
WHEREAS, the City and Consultant agree to amend the original agreement to include
additional services associated with the additional coordination efforts by the consultant with the
U.S. Army Corps. of Engineers to determine which wetland/Waters of the US features identified
in the Delineation Report would be regulated, evaluation of multiple roadway alignments to
minimize regulated resources impacts to stay beneath the Nationwide Permit thresholds and
attendance to additional project meetings beyond the original scope; AND,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Amendment No. 2 to the Agreement for Professional Consulting Services between Foth
Infrastructure and Environment, LLC and the City of Waukee, Iowa [Kettlestone Burt Property
Environmental Services Project] is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 17th day of June 2024.
