Hickman Rd. and electronically via Zoom. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R. Charles Bottenberg, Chris Crone, Rob Grove, Anna Bergman Pierce (electronically), Ben Sinclair (electronically). Absent: None. Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne, Community Development Director Andy Kass, Planning Coordinator Melissa DeBoer, Director of Economic Development Jennifer Brown, Human Resources Director Michelle Lindsay, Public Works Director/City Engineer Rudy Koester, Park & Recreation Director Matt Jermier, IT Director Son Le, Director of Marketing & Communications Heather Behrens (electronically), Police Chief Chad McCluskey, Police Officer Wyatt Johnson, City Clerk Rebecca D. Schuett, City Attorney Steve Brick (electronically). (D) Open Forum – 1) Shannon and Gabe Sink, no address given, addressed the council about their concerns regarding Agenda Item #I4 (Chapter 55, Animal Protection and Control). They stated that a neighbor has a large number of pigeons and they noted issues with the smell and mess, concerns with parasites and diseases carried by pigeons, and questions regarding that neighbor’s compliance with the ordinance. 2) Dave Hunt, no address given, stated that he lives next door to the same resident keeping the pigeons and reiterated the concerns brought up by the Sinks, adding that the pigeons are also noisy. (E) Agenda Approval – Council Member Crone moved to approve the agenda; seconded by Council Member Grove. Results of vote: Ayes: Bottenberg, Crone, Grove, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (F) Presentations: None (G) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from R-2 to R-2/PD-1, a parcel known as Fox Creek Meadows – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Planning Coordinator DeBoer reviewed the rezoning application, stating that the property had initially been zoned for duplex development and that due to market demand, the applicant now requests a PD overlay to allow for smaller detached homes. No correspondence either for or against the application has been received by City staff. Ms. DeBoer discussed stormwater detention, parkland dedication and landscape buffering. She noted that the PD allows for smaller lot sizes with reduced setbacks in exchange for certain exterior building materials; vinyl siding is prohibited as part of the PD zoning. Council Member Bottenberg stated that the proposed lots appeared very small and asked if there was anything comparable elsewhere in the city; Community Development Director Kass noted another development within the nearby Stratford Crossing development and added that duplex lots were not selling, leading the developer to apply for rezoning. Council Member Crone asked if the homes would have basements; Mr. Kass replied in the affirmative. Council Member Grove asked for additional information on potential house sizes. Mayor Clarke stated that smaller single family lots have been approved by council in the past, adding that the overall neighborhood contained a mix of housing options. She also noted that the developer had agreed to certain concessions in exchange for smaller lots. No comments were made by the public in attendance. I1B 2 (H) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from R-2 to R-2/PD-1, a parcel known as Fox Creek Meadows [introduction; first reading] – Council Member Crone introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Bottenberg. Results of vote: Ayes: Bottenberg, Crone, Grove, Pierce, Sinclair. Nays: None. Motion carried 5 – 0. (I) Action Items: 1) Consent Agenda: Council Member Grove moved to approve the Consent Agenda; seconded by Council Member Crone. Council Member Bottenberg stated that he would abstain from voting due to a professional conflict of interest. Results of vote: Ayes: Crone, Grove, Pierce, Sinclair. Nays: None. Abstentions: Bottenberg (professional conflict of interest). Motion carried 4 – 0 – 1. A.
