HomeMy WebLinkAbout2024-07-15 Resolution 2024-303_Partial Release and Satisfaction for Development Agreement, Temple Holdings LPTHE CITY OF WAUKEE, IOWA RESOLUTION 2024-303 APPROVING A PARTIAL RELEASE AND SATISFACTION FOR DEVELOPMENT AGREEMENT — TEMPLE HOLDINGS, LP IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, Temple Holdings, LP, (collectively "Property Owners") entered into a Development Agreement ("Agreement") with the City of Waukee, dated May 20, 2019, and recorded on June 3, 2019, in Book 2019 Page 8511, Dallas County, Iowa regarding development of NW Douglas Parkway. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa that the terms of the Agreement have been partially satisfied and the City releases the Property Owners and their successors and assigns, from all obligations under said Developers Agreement as it pertains to the following legally described area: A PART OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 21, TOWNSHIP 79 NORTH, RANGE 26 WEST OF THE FIFTH PRINCIPAL MERIDIAN IN THE CITY OF WAUKEE, DALLAS COUNTY, IOWA AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF PARKSIDE PROPER PLAT 1, AN OFFICIAL PLAT; THENCE NORTH 89°46'00" WEST ALONG THE NORTH RIGHT OF WAY LINE OF NW DOUGLAS PARKWAY, 286.21 FEET; THENCE NORTH 00014100" EAST, 294.09 FEET; THENCE SOUTH 89°46'00" EAST, 286.21 FEET TO THE WEST LINE OF SAID PARKSIDE PROPER PLAT 1; THENCE SOUTH 00°14'00" WEST ALONG SAID WEST LINE, 294.09 FEET TO THE POINT OF BEGINNING AND CONTAINING 1.93 ACRES (84,173 SQUARE FEET).
