The City and the consultant agree to amend the original Agreement and amendment 1 to include additional services associated with: Additional Final Design Services through Phase 1 construction consists of the following: o Water Main modifications o Sanitary Sewer modifications o Traffic modifications o Grading modifications o Storm Sewer Modifications o MidAmerican Easement o Construction Survey o Additional Construction Administration FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: The original agreement was for $400k, which entailed preliminary engineering services. Amendment 1 was for $801k, which included final design, bidding and construction administration services. Amendment 2 is for $160,500, which includes the additional final design and construction administration items listed above. Total contract amount of will be $1,361,500 pending amendment 2 approval. Engineering Services Amendment No. 2 with Foth PREPARED BY: Beth Richardson REVIEWED BY: Rudy Koester RK I13 THE CITY OF WAUKEE, IOWA RESOLUTION 2024- APPROVING AMENDMENT NO. 2 TO AGREEMENT FOR PROFESSIONAL CONSULTING SERVICES WITH FOTH INFRASTRUCTURE AND ENVIRONMENT, LLC [T AVENUE CORRIDOR IMPROVEMENTS, W HICKMAN ROAD TO NW DOUGLAS PARKWAY] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, on April 18, 2022, the City retained the services of Foth Infrastructure and Environment, LLC for the T Avenue Corridor Improvements, W Hickman Road to NW Douglas Parkway (RES 2022-168); AND, WHEREAS, on February 6, 2023 the City Council approved Amendment No. 1 to the agreement; AND, WHEREAS, the scope of services is amended to include additional services for water main modifications, sanitary sewer modifications, traffic modifications, grading modifications, storm sewer modifications, MidAmerican Easement, Construction Survey, and additional construction administration; AND, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that Amendment No. 2 to the Agreement for Professional Consulting Services between Foth Infrastructure and Environment, LLC and the City of Waukee, Iowa [T Avenue Corridor Improvements, W Hickman Road to NW Douglas Parkway] is hereby approved. Hickman Rd to NW Douglas Pkwy Waukee, Iowa Page 1 ENGINEERING SERVICES AMENDMENT NO. 2 PROJECT NO. 22W007.00 THIS AMENDMENT, made and entered into this 5th_ day of __August__ 2024 by and between, the CITY OF WAUKEE, IOWA, hereinafter referred to as the “City”, and FOTH INFRASTRUCTURE AND ENVIRONMENT, LLC., hereinafter referred to as the "Consultant", for professional services in connection with the preliminary survey and mapping, functional design, for the proposed improvements of T Avenue Corridor Improvements, from W Hickman Road to NW Douglas Parkway, hereby amends the original Agreement dated April 18th, 2022 and Amendment #1 dated February 6th, 2023 as follows: The City and Consultant agree to amend the original Agreement to include additional services associated with: • Additional Final Design Services through Phase 1 Construction consists of the following: o Water Main modifications o Sanitary Sewer modifications o Traffic modifications o Grading modifications o Storm Sewer Modifications o MidAmerican Easement o Construction Survey o Additional Construction Administration I. Basic Services of the Consultant The Consultant shall consult on a regular basis with the City to clarify and define the City’s requirements for the Project and review available data. The City agrees to furnish to the Consultant full information with respect to the City’s requirements, including any special or extraordinary considerations for the Project or special services needed, and also to make available pertinent existing data. The Consultant shall provide the following basic services in regard to the Project: A. FINAL PLANS AND SPECIFICATIONS Task 1 – Water Main Modifications • Approximately 800 LF of 20-inch water main was added to the project from T Avenue to a future water tower site at the SE corner of the Public Safety Site parcel. • A total of three (3 ) water service lines to properties south of Hickman Road were added to switch water service from Xenia to City of Waukee. Task 2 – Sanitary Sewer Modifications • Approximately 800 LF of 12-inch sanitary sewer was added to the project from T Avenue to a future water tower site at the SE corner of the Public Safety Site parcel. Task 3 – Traffic Modifications • Approximately 2 miles of interconnect was added along T Avenue from Hickman Road to Douglas Parkway, and along Douglas Parkway from T Avenue to 10 th Street. • Iowa DOT requested adding advanced warning flashers to the intersection of Hickman Road and T Avenue. B. CONSTRUCTION ADMINISTRATION Task 1 –Sanitary Sewer Modifications Foth Infrastructure and Environment, LLC T Avenue Corridor Improvements Project Number 22W007.00 W. Hickman Rd to NW Douglas Pkwy Waukee, Iowa Page 2 • Redesign and a plan revision was needed for the sanitary sewer along NW 20th Street (T Avenue) to accommodate a request by the contractor to use a different installation method adjacent to the Xenia water main north of Hickman. • A plan revision was needed to add an external drop connection and a 4” stub west from a manhole for the WCSD bus barn. Task 2 – Traffic Modifications • Fiber added to run 2 miles along Hickman Road and T Avenue approximately 2 miles to the Public Safety Building for City fiber connectivity. Task 3 – Grading Modifications • Redesign of NW Douglas Parkway grading to reduce the size of stockpiles located on the City’s Outlot to preserve tillable land. • Revised pond grading for MidAmerican equipment along Douglas. Task 4 – Storm Sewer Modifications • Roof drain modification for the Waukee Public Safety Building requiring 2 connections rather than 1 to be able to visual tell when the overflow pipes are operating . Task 5 – MidAmerican Easement and Platting • Additional 10’ electric easement was necessary after Final plat was delivered due to the change in location for electric service from MidAmerican Switch Gear within City ROW to proposed Transformer location on Waukee Public Safety Site. Task 6 – Construction Survey • Additional water main and sanitary sewer for future ASR. Task 7 – Additional Construction Administration • Additional coordination and plan changes for Public Safety Building project • Additional coordination for construction extending past completion date of 9/30/2024. Construction administration is assumed to take place until May 30, 2025. SCHEDULE The Consultant shall complete the following phases of the Project in accordance with the schedule shown; assuming notice to proceed is issued by the City on or before February 6, 2023. II. Basic Services of the Consultant A. Construction Services August 2023 – November 2024 May 2025 In consideration for these services, the City agrees to adjust the compensation for services performed by the Consultant. These fees are based on the standard hourly rates of the Consultant’s personnel actually engaged in the performance of the services, plus direct out-of-pocket costs for expenses incurred by personnel who are actually engaged in the work and other direct costs. The total Hourly Not-to-Exceed fees for the professional engineering services as described in this amendment are as follows: I. THIS AMENDMENT, together with the original Agreement and Amendment 1 represents the entire and integrated AGREEMENT between the City and Consultant.
