Agreement Certificate of Completion Public Improvements for AP
North, L.C.

SYNOPSIS INCLUDING PRO & CON:
The development agreement between the City and AP North, L.C. includes public improvements
involving the design and construction of a reginal storm water pond to be dedicated to the city
upon completion.
City Council accepted public improvements from AP North, L.C. on May 20, 2024
Total costs submitted for the public improvements is $2.2M. Per the agreement, maximum grant
amount cannot exceed $2M.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
Regional storm water pond was needed to new commercial development including UnityPoint
Medical Park. The investment in infrastructure will result in $20+M of new commercial.

THE CITY OF WAUKEE, IOWA
RESOLUTION 2024
APPROVING ACCEPTING CERTIFICATE OF COMPLETION,
MINIMUM IMPROVEMENTS [AP NORTH L.C.]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on July 10, 2023, the Waukee City Council approved a Development Agreement by and
among the City of Waukee and AP North, L.C. (Resolution #2023-286); AND,
WHEREAS, pursuant to the terms of the Development Agreement, the Developer is obligated to
construct certain Public Improvements as defined within the Development Agreement; AND,
WHEREAS, the Developer constructed Ashworth North Plat 3 – Regional Detention Pond in general
conformance with standard specifications for the City; AND
WHEREAS, the developer demonstrated to the City that they have met and are in compliance with the
Public Improvements requirement.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council that the Certificate of
Completion, Minimum Improvements [AP North, L.C.], is hereby accepted and that the Mayor is
authorized to execute the same on behalf of the City.
BE IT FURTHER RESOLVED that the City Clerk is directed to record the executed Certificate of
Completion, Minimum Improvements, with the County Recorder of Dallas County.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 3rd day of September,
2024.
