[Apple, Inc., and Broderick Farm Company]
FORMAT:Resolution
SYNOPSIS INCLUDING PRO & CON: This agreement between the City of Waukee and
Broderick Farm Company is for crop damages that occurred along the west perimeter of the T
Avenue Improvement Project. These damages were a result of the contractor not maintaining
proper stormwater drainage through the project site, resulting in water ponding and crop damages
to occur on the adjacent Apple property currently being farmed by the Broderick Farm Company.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Payment in the amount of
$3,180.64 to Broderick Farm Company.
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: Staff recommends approval of the resolution and crop
damage claim form.
RECOMMENDATION: Approve the resolution

RESOLUTION 2024-
APPROVING CROP DAMAGE CLAIM
[APPLE, INC. AND BRODERICK FARM COMPANY]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, this is an agreement between the City of Waukee and Broderick Farm Company
for loss of crop within the Apple, Inc. property; AND,
WHEREAS, the damages are a direct result of the work performed as part of the T Avenue
Improvements Project; AND,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee the Crop
Damage Claim [Broderick Farm Company] is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 3rd day of September,
2024.
