SYNOPSIS INCLUDING PRO & CON:
In 2023, City Council approved plans for construction of Ashworth North Plat 3 – Regional
Detention Pond associated with the development of UnityPoint Medical Park and additional
commercial development. The developer has completed construction of the Regional Detention
Pond which is in conformance with the City’s standard specifications. For the city to take
ownership of the pond, the property must be deeded to the City.

RESOLUTION 2024
APPROVING WARRANTY DEED [AP NORTH L.C.]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, AP North, L.C. constructed Ashworth North Plat 3 – Regional Detention Pond, per the
Development Agreement with City; AND
WHEREAS, AP North, L.C. is required to dedicate public improvements to the City to fulfill
obligations in the Development Agreement;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council that the warranty
weed for Ashworth North Plat 3 – Regional Detention Pond [AP North, L.C.], is hereby accepted and
that the Mayor is authorized to execute the same on behalf of the City.
BE IT FURTHER RESOLVED that the City Clerk is directed to record the executed deed with the
County Recorder of Dallas County.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 3rd day of September,
2024.
