HomeMy WebLinkAbout2024-10-07 H02A Elm St Property Purchase Agreement AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: October 7, 2024 AGENDA ITEM: Consideration of approval of a resolution approving the Purchase Agreement of Easement Interests pursuant to Iowa Code Section 364.7 (2024) [Elm Street Property] FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: City staff has been approached by the owner of the commercial building located at 750 W. Hickman Road regarding a parking lot expansion. The proposed parking lot expansion would encroach onto property owned by the City of Waukee south of existing building. The building owner is requesting an easement from the City to allow for the proposed parking expansion to be partially located on property owned by the City of Waukee. JDS Real Estate Investments, LLC, the developer of 750 W. Hickman Road, submitted an offer to the city to purchase the easement interest. The purchase offer provided is $9,440.00. The offer is based on $2.50 per square feet of easement area (3,776 square feet). FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the Purchase Agreement of Easement Interests pursuant to Iowa Code Section 364.7 (2024) [Elm Street Property]. Purchase Agreement PREPARED BY: Andy Kass, Community Development Director REVIEWED BY: H2A THE CITY OF WAUKEE, IOWA RESOLUTION 2024- APPROVING PURCHASE AGREEMENT FOR PARKING EASEMENT [ELM STREET PROPERTY] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the City has received a request to purchase a permanent easement on property owned by the City of Waukee and generally located south of the property located at 750 W Hickman Road for purposes of expansion of a parking lot; AND, WHEREAS, JDS Real Estate Investments, L.L.C. has submitted a Purchase Agreement in the amount of $9,440.00 for purposes of easement interests in the property; AND, WHEREAS, the Council has determined that the Purchase Agreement for Easement Interests is in the best interest of the City and the residents thereof; NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council that the Purchase Agreement for Easement Interests [Elm Street Property] is hereby approved, and the Mayor and the City Clerk are authorized to execute the Agreement for and on behalf of the City.
