HomeMy WebLinkAbout2024-11-18 I01G_02 28E Agr Cancellation_Heart of IowaAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: November 18, 2024 AGENDA ITEM:Consider resolution providing notice of intent to terminate 28E agreement with Heart of Iowa Community Services related to crisis intervention team funding based on State of Iowa mental health realignment. FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: The recent efforts by the State of Iowa related to behavioral health redistricting will result in the dissolution of Heart of Iowa Region with the new behavioral health districts. Heart of Iowa Region is the organization with whom the City of Waukee entered into a 28E agreement in May of 2022 for Crisis Intervention Team funding and program setup. Based on the redistricting, Chief McCluskey contacted City Attorney Steve Brick for guidance related to the 28E currently between the City and Heart of Iowa. To ensure a clean transition during the redistricting, City Attorney Brick recommended providing notification to Heart of Iowa of the City’s intent to cancel the 28E with Heart of Iowa as of June 30, 2025. The 28E includes language requiring 6-months notice for cancellation, and this resolution would ensure the 6-months notice requirement is met. Our hope is to engage with the new State of Iowa appointed Area Service Organization (ASO), once the ASO is identified, to seek opportunities to maintain funding for our program. The current management of Heart of Iowa Region has applied to be the ASO for our district, however regardless of the agency being awarded the ASO, a new 28E would need to be drafted with that organization. This resolution ensures a clean separation between the City and Heart of Iowa in accordance with the 28E requirements and will allow us to move forward with any other opportunities in the future. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: There is no fiscal impact associated with the proposed amendment. IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the City of Waukee entered into a 28E agreement with Heart of Iowa Region on May 16, 2022 for the purposes of creating and funding a Crisis Intervention Team (CIT); AND, WHEREAS, the State of Iowa has initiated a statewide behavioral health redistricting plan which will effectively eliminate the Heart of Iowa region, and absorb the Heart of Iowa region into the new State of Iowa Behavioral Health District 5; AND, WHEREAS, the 28E with Heart of Iowa region would likely dissolve with the changes by the State of Iowa as of June 30, 2025, therefore providing notice to terminate the 28E agreement in accordance with the agreement language will afford the City of Waukee an opportunity to consider additional partnerships with the new Area Service Organization chosen by the State of Iowa. The City of Waukee is also aware of your interest in becoming the ASO for the new district which will encompass the City of Waukee. Regardless of the organizafion chosen by the State of Iowa as the new ASO for the district encompassing the City of Waukee, the current 28E between the City of Waukee and Heart of Iowa Region, executed on May 16, 2022, would likely dissolve as of June 30, 2025 in conjuncfion with the new district and ASO. As a result of the inevitable change, the City of Waukee has a desire to ensure a smooth transifion and we are therefore giving nofice per Arficle VI, secfion 6.1, of the terminafion of the 28E. According to Arficle VI, secfion 6.1, “Term. The inifial term of this Agreement shall commence July 1, 2022 and confinue for a period of three (3) years. The Agreement shall renew automafically for two (2) year terms, unless the cancelling party provides six (6) months’ nofice prior to the expirafion of the inifial term or extension.” The City of Waukee is hereby giving nofice of its cancellafion of the 28E Agreement upon the expirafion of the inifial term, July 1, 2025. Once a new ASO is chosen for the region encompassing the City of Waukee, we hope to work closely with the ASO to partner in an effort to confinue our Crisis Intervenfion Team in any way possible with the reorganizafion. We value and appreciate the partnership with Heart of Iowa in standing up our Crisis Intervenfion program and we hope to confinue to work together to benefit our community. With the redistricfing and the inevitable dissolufion of the 28E with Heart of Iowa, we simply want to ensure a clear and smooth transifion as we work through the new alignment inifiated by the State of Iowa.
