AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 35, Fire
Department, by repealing Section 35.07, Constitution, and enacting in lieu
thereof Section 35.07, Department Rules [introduction; first, second, third
(final) readings]
FORMAT:Ordinance
SYNOPSIS INCLUDING PRO & CON: Section 35.07 of the Waukee municipal code is related to
rules of fire department operations. The current language is from when the department was all
volunteer and relates to having a constitution and by-laws. The new language more accurately reflects
current operations.
Old language:
The department shall adopt a constitution and bylaws as they deem calculated to accomplish the object
contemplated, and such constitution and bylaws and any change or amendment to such constitution
and bylaws before being effective, must be approved by the Council.
New Language
The Fire Chief shall establish such rules, not in conflict with the Code of Ordinances, as may be
necessary for the operation of the department.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: There is no financial impact to
the ordinance change.
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: The proposed ordinance is considered a housekeeping matter.
The Code of Iowa requires a vote of not less than three-fourths of all the
members of the council (or 4 out of 5, in Waukee’s case) in order to waive
readings of an ordinance.
RECOMMENDATION: Introduce the ordinance, move to approve the first reading in title only,
waive the second and third readings and place the ordinance on final passage.

AN ORDINANCE TO AMEND CHAPTER 35, FIRE DEPARTMENT, BY REPEALING
SECTION 35.07, CONSTITUTION, AND ENACTING IN LIEU THEREOF SECTION
35.07, DEPARTMENT RULES
WHEREAS, the City of Waukee Fire Department has determined that it is necessary to
amend Chapter 35, Fire Department, to more accurately reflect current practices;
BE IT THEREFORE ORDAINED by the City Council of the City of Waukee:
Section 1: Chapter 35, Fire Department, Section 35.07, Constitution is hereby repealed
and Section 35.07, Department Rules, is enacted in lieu thereof as follows:
35.07 DEPARTMENT RULES.
The Fire Chief shall establish such rules, not in conflict with the Code of Ordinances, as
may be necessary for the operation of the department.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect from and after its final
passage, approval and publication as provided by law.
