RESOLUTION 2024-458
APPROVING THE VACATION OF PORTION OF A PUBLIC SANITARY SEWER
EASEMENT [PARKSIDE COMMERCIAL PLAT 11
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City has previously approved a Public Sanitary Sewer Easement which exists
by virtue of the plat, Parkside Proper Plat 1, filed on March 1, 2023, and recorded in Book 2023,
Page 2519, and the easement document filed on March 1, 2023, recorded in Book 2023, Page
2528 (the "Easements"); AND,
WHEREAS, it has been determined that the Easement as described on attached Exhibit A is no
longer needed; AND,
WHEREAS, the property owner has requested that the Easement as described in attached
Exhibit A be vacated.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
4'' day of November 2024, that it hereby approves the vacation of the portion of the Public
Sanitary Sewer Easement.

COMMENCING AT THE SOUTHEAST CORNER OF SAID LOT 1; THENCE NORTH 00°14'00"
EAST ALONG THE EAST LINE OF SAID LOT 1, A DISTANCE OF 175.00 FEET; THENCE SOUTH
89046'06" WEST, 20.00 FEET TO THE POINT OF BEGINNING; THENCE NORTH 89°46'06" WEST,
51.54 FEET; THENCE NORTH 00°13'54" EAST, 40.00 FEET; THENCE SOUTH 89°46'06" EAST,
51.54 FEET; THENCE SOUTH 00°14'00" WEST, 40.00 FEET TO THE, POINT OF BEGINNING AND
CONTAINING 0.05 ACRES (2,061 SQUARE FEET).
