AGENDA ITEM:Consideration of approval of a resolution approving and authorizing the
acquisition of property and property interests for the Alice’s Road
Improvements Phase 1A Project
FORMAT:Resolution
SYNOPSIS INCLUDING PRO & CON: This project includes all materials, equipment,
transportation and labor necessary to reconstruct Alice’s Road from a two-lane rural section to a
four-lane boulevard section including PCC pavement, PCC trail and pedestrian ramps. Project
items include subgrade preparation and treatment, PCC roadway paving, trail and ramp paving,
pavement markings, storm sewer installation, water main installation, Joint Utility Trench (JUT)
installation, traffic control, erosion control, and surface restoration. The project location is on NE
Alice’s Road from NE Horizon Drive to NE Dellwood Drive.
Under the provisions of Chapter 6B of the Iowa Code, a governmental body which proposes to
acquire non-agricultural land under power of eminent domain for a public improvement project is
required to approve a resolution to commence the project, to acquired property in whole or in part
for the project and if necessary, through the use of eminent domain. City of Waukee staff are
working to complete the necessary acquisitions from four property owners through good faith
negotiations. Staff recommend approving the resolution to authorize the use of eminent domain in
the event the good faith negotiations are not completed successfully or in a timely manner to allow
the Alice’s Road Improvements Phase 1A project to stay on it’s planned construction schedule.

RESOLUTION 2025-
RESOLUTION APPROVING AND AUTHORIZING THE ACQUISITION OF
PROPERTY AND PROPERTY INTERESTS FOR THE ALICE’S ROAD
IMPROVEMENTS PHASE 1A PROJECT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee desires to undertake the expansion of Alice’s Road in Waukee
in coordination with the City of Clive which is responsible for the approximately one half of the
road within Clive’s City limits in a project that is named Alice’s Road Improvements Phase 1A;
and
WHEREAS, this project includes all materials, equipment, transportation and labor necessary to
reconstruct Alice’s Road from a two-lane rural section to a four-lane boulevard section including
PCC pavement, PCC trail and pedestrian ramps. Project items include subgrade preparation and
treatment, PCC roadway paving, trail and ramp paving, pavement markings, storm sewer
installation, water main installation, Joint Utility Trench (JUT) installation, traffic control, erosion
control, and surface restoration. Specific project location along with the kind and approximate
quantity of materials to be used shall be as set forth in the Plans and Specifications; and
WHEREAS, the City determines there is a reasonable expectation that the project will achieve
the public purpose, comply with applicable standards and obtain all necessary permits; and
WHEREAS, rights-of-way, easements and temporary construction easements will need to be
acquired for the construction of the public improvement; and
WHEREAS, the City staff or its designee has established fair market values by appraisal for the
necessary right of way and easement(s); and
WHEREAS, the City will need to acquire certain property interests on properties within the City
Limits of the City of Waukee, specifically portions of those properties included in parcel numbers
parcel ID 1227404002, parcel ID 1227403002, parcel ID 1227400007 and parcel ID 1227278000
to complete the project and achieve the public purpose; and
WHEREAS, in accordance with Iowa law, a government body shall make a good faith effort to
negotiate with the property owner to purchase the private property or property interest before filing
an application for condemnation or otherwise proceeding with the condemnation process.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Waukee, Iowa,
that the public improvement known as the Alice’s Road Improvements Phase 1A Project is in the
best interest of the City and is approved in the location and in accordance with plans on file in the
Waukee City Clerk’s Office; and
BE IT FURTHER RESOLVED, that the City staff or its designee be and is hereby authorized to
proceed with the necessary activities and negotiations to acquire by purchase, gift, or
condemnation , if necessary, the necessary property and/or property interests required for the
construction of said public improvement.
Passed by the City Council of the City of Waukee, Iowa, and approved this 6th of January, 2025.
