STAFF REVIEW AND COMMENT The total final construction cost was listed incorrectly on
Resolution No. 2025-026. The correct amount is $495,063.85.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2025-
RESOLUTION CORRECTING SCRIVENER’S ERROR AND
AMENDING RESOLUTION NO. 2025-026 TO CORRECT THE
TOTAL FINAL CONSTRUCTION COST FOR THE 2023
ASPHALT OVERLAY IMPROVEMENTS: ASHWORTH DRIVE
FROM 4TH TO 10TH STREET
WHEREAS, on January 6, 2025, the City Council adopted Resolution No. 2025-026
accepting the 2023 Asphalt Overlay Improvements: Ashworth Drive from 4th to 10th Street;
WHEREAS, in said resolution, the City Council approved the final total construction cost
in the amount of $551,162.73;
WHEREAS, it was later determined that the final total construction cost is in the amount
of $495,063.85 which constitutes a scrivener’s error that should be corrected.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WAUKEE, STATE OF IOWA:
Section 1.That the final total construction cost in Resolution No. 2025-026 is hereby
corrected and amended as follows:
That the report of the Engineer be and the same is hereby approved and adopted, and the
public improvements are hereby approved and accepted as having been fully completed in
accordance with the plans, specifications and form of contract and the total final
construction cost thereof is hereby determined to be $495,063.85, as shown in the report
of the Engineer.
Section 2. That those provisions of Resolution No. 2025-026 identified herein are hereby
repealed and replaced to the extent inconstant with this Resolution.
Section 3.That all other provisions of Resolution No. 2025-026 adopted by this Council
on January 6, 2025, are hereby approved and all actions taken by the Mayor and City Clerk are
hereby ratified and confirmed.
