AGENDA ITEM: Consideration of approval 28E Agreement with the Iowa Department of
Revenue for Alcohol Enforcement.
FORMAT: Consent Agenda
SYNOPSIS INCLUDING PRO & CON: The Waukee Police Department has been approached
by the Iowa Department of Revenue regarding a new reimbursement
program for alcohol enforcement mirroring tobacco enforcement
agreements. This agreement includes provisions by which the Waukee
Police Department conducts compliance checks with various retailers in
the City selling alcohol through June 30, 2025. The State of Iowa pays
the City $100 per compliance check completed in line with the program
not to exceed 20 compliance checks / $2,000 total, and the Waukee
Police Department simply acts as a force multiplier of the Iowa
Department of Revenue for these compliance checks.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
The Iowa Department of Revenue issues payment in the amount of $100 per compliance check
completed by the Department as part of the program. The Waukee Police Department could
receive up to $2,000 in additional revenues by joining this effort, while ensuring our retailers are
compliant with laws related to the sale of alcohol.

RESOLUTION 2025-
APPROVING 28E AGREEMENT WITH THE IOWA DEPARTMENT OF REVENUE
FOR ALCOHOL ENFORCEMENT
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS, the Iowa Department of Revenue contacted the Waukee Police Department
regarding a reimbursement program for alcohol compliance enforcement; AND,
WHEREAS, the proposed 28E agreement include provisions by which the Waukee Police
Department conducts compliance checks with various retailers in the City selling alcoholic
beverages; AND,
WHEREAS, the Waukee Police Department recommends entering into a 28E agreement with
the Iowa Department of Revenue for alcohol compliance enforcement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WAUKEE, IOWA:
That the 28E Agreement with the Iowa Department of Revenue for Alcohol Enforcement
is hereby approved and accepted by this City Council, and the Mayor is hereby
authorized and directed to execute said agreement on behalf of the City.
Passed by the City Council of the City of Waukee, Iowa, and approved this 3rd day of February,
2025.
