AGENDA ITEM: Consideration of approval of a resolution approving Warranty Deed from
Philip E. Broderick, LLC
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: As part of the improvements for NW 2nd Street, the City
acquired right-of-way from various property owners. Upon completion of the
project, it was found that a small remnant piece of property remained that
should have been acquired by the City during the initial acquisitions. The
property owner, Philip E. Broderick, LLC, has agreed to grant ownership of
the property to the City. For the City to take over ownership of the right-of-
way, the City needs to accept the deed and file it with the Dallas County
Recorder’s Office.

RESOLUTION 2025-
APPROVING WARRANTY DEED WITH PHILIP E. BRODERICK, LLC
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City approved construction plans for NW 2nd Street; AND,
WHEREAS, as upon completion of the improvements for NW 2nd Street, a remnant parcel of
right-of-way remained owned by Philip E. Broderick, LLC
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that
the warranty deed for property owned Philip E. Broderick, LLC, be approved.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 17th day of
March, 2025.
