HomeMy WebLinkAbout2025-04-21 I01F_05 Lease Agr_1255 3rd St_VerizonAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: April 21, 2025 AGENDA ITEM:Consideration of approval of a resolution approving Amended and Substituted Lease Agreement, 1255 3rd Street Site, with Cellco Partnership, d/b/a/ Verizon Wireless FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: The original lease agreement was approved by City Council on April 18, 2016 (RES# 16-134) allowing Verizon Wireless to rent space to install antennas on the City’s existing water tower. From the effective date of the Amended and Substituted Lease from 1st day of May, 2025, Landlord nonexclusively leases to Tenant and Tenant nonexclusively leases from the landlord a portion of the Property, consisting of space on the new water tower’s roof for antennas and a fifteen (15’) by seven foot (7’) floor space located on the second floor of the new water tower which shall contain equipment appurtenant to the antennas. Effective date of the lease will be August 1, 2025. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $42,434.37 Annual Rent for calendar year 2025 with a 3% annual escalator. Amended and Substituted Lease Agreement PREPARED BY:Lisa Bauman REVIEWED BY:Rudy Koester RK I1F5 THE CITY OF WAUKEE, IOWA RESOLUTION 2025- APPROVING AMENDED AND SUBSTITUED LEASE AGREEMENT FOR 1255 3RD STREET SITE WITH CELLCO PARTNERSHIP, D/B/A VERIZON WIRELESS IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the City approved the original Lease Agreement on April 18, 2016 (RES #2016- 134) and as amended by Amendment No. 1 to Lease Agreement dated August 10, 2022, allowing Verizon to install 9 directional antennae’s and connecting cables on the existing water tower; AND, WHEREAS, the Tenant and City desire an Amended and Substituted Lease Agreement to document the relocation and modifications to the Verizon owned facilities equipment to be relocated on the new water tower; AND, WHEREAS, the 2025 rent shall be $42,434.37 per year due August 1, 2025 and an annual escalator of 3% shall be applied to the annual rent. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the Amended and Substituted Lease Agreement, 1255 3rd Street Site between Cellco Partnership, d/b/a Verizon Wireless. and the City of Waukee, Iowa is hereby approved.
