HomeMy WebLinkAbout2025-06-16 Resolution 2025-231_28E Agreement, Waukee Community School District Transportation Facility Sanitary Sewer ServiceTHE CITY OF WAUKEE, IOWA RESOLUTION 2025-231 APPROVING 28E AGREEMENT BETWEEN THE CITY OF WAUKEE, IOWA; WAUKEE COMMUNITY SCHOOL DISTRICT AND URBANDALE SANITARY SEWER DISTRICT [SCHOOL TRANSPORTATION FACILITY SANITARY SEWER SERVICE] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, this Chapter 28E Agreement, entered into by the Urbandale Sanitary Sewer District, a sanitary sewer district organized and existing under Chapter 358 of the Iowa Code ("USSD"), the Waukee Community School District, an Iowa public school district ("WCSD"), and the City of Waukee, Iowa, an Iowa municipal corporation ("Waukee"); AND, WHEREAS, the USSD currently does not possesses a sanitary sewer which serves the WCSD Transportation Facility; AND, WHEREAS, Waukee currently does possesses a sanitary sewer which can service the WCSD Transportation Facility; AND, WHEREAS, the WCSD has constructed a new transportation facility on property owned by the WCSD located at 29268 260th Street, Dallas Center, IA 50063. This Facility is located outside Waukee's corporate limits and within the future sanitary service territory of the US SD. However, the most convenient and economical way for the Facility to receive sanitary sewer service is by pumping it sewage by force main into Waukee and connecting with the Waukee's gravity sanitary sewer collection system at the intersection of NW 20th St and NW Douglas Pkwy; AND, WHEREAS, The Facility will be charged the Waukee sanitary sewer rate on a monthly basis, the same as any other Waukee utility customer based on the Facility's water consumption. The Facility is serviced by Xenia Rural Water District and Xenia will share with Waukee the Facility's monthly water meter readings for utility billing purposes; AND, WHEREAS, the Parties desire to enter into this Agreement to set forth and to establish their agreement with respect to the design and allocation of costs of the Transportation Facility Sanitary Sewer Service which is designed to serve the Transportation Facility. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee approve a 28E Agreement between the USSD, WCSD, and City of Waukee, Iowa [School Transportation Facility Sanitary Sewer Service] is hereby approved.
