RESOLUTION 2025-257
APPROVING AMENDED AND SUBSTITUED LEASE AGREEMENT FOR
1255 3RD STREET SITE WITH USCOC OF GREATER IOWA, LLC.
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City approved the original Lease Agreement on June 4, 2012 (RES #12-135)
and as amended by Amendment No. 1 to Lease Agreement dated January 20, 2020, and as
amended by Second Amendment to Lease Agreement dated May 15, 2023 allowing USCOC of
Greater, Iowa, LLC., to install 9 directional antennae's and connecting cables on the existing
water tower; AND,
WHEREAS, the Tenant and City desire an Amended and Substituted Lease Agreement to
document the relocation and modifications to the USCOC of Greater Iowa, LLC., owned
facilities equipment to be relocated on the new water tower; AND,
WHEREAS, the 2025 rent shall be $39,932.37 per year due August 1, 2025 and an annual
escalator of 3% shall be applied to the annual rent.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Amended and Substituted Lease Agreement, 1255 3`d Street Site between USCOC of Greater
Iowa, LLC., and the City of Waukee, Iowa is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 7th day of July, 2025.
