HomeMy WebLinkAbout2025-09-02 G02 15705 University Rezoning_PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: September 2, 2025 AGENDA ITEM: Public hearing on an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from C-4 [Office Park Commercial District] to C-1A [Neighborhood Commercial District] (15705 University) FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: The owner and applicant is MDBB 1, LLC Series 4. The property is located north of SE University Avenue and west of SE Waco Place, containing 0.79-acres. The subject property is part of a larger parcel that was previously rezoned in 2020 from C-4/PD-1 (Office Park Commercial District with a Planned Development Overlay) to C-4 (Office Park Commercial District) and C-1A (Neighborhood Commercial District). The applicant is requesting to rezone a portion of the C-4 area to C-1A in order to expand the C-1A area to accommodate future development of a building that will include retail and restaurant uses. Notification of the rezoning request was sent out on August 15th. The rezoning sign was placed on the property by the required deadline. Staff have not received any correspondence for or against the request. The concept plan provided shows a total of three lots and one outlot. Lot 2 includes the area proposed to be rezoned to C-1A and includes one building that is proposed to include retail and restaurant uses. Lots 1 and 3 are zoned C-4 and are shown to include one building on each lot for office use. The outlot is located in the northwest corner of the overall development and will be used for storm water detention. One full access is shown to provide access to the overall site off of SE University Avenue. The current comprehensive plan classifies the subject property as Single-Family Residential. Although the proposed rezoning is not consistent with the comprehensive plan, staff is comfortable with proposed rezoning as it is compatible with the existing zoning of the property and also with the zoning of other properties nearby along University Avenue. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed the rezoning request on August 26, 2025, and recommended approval: Approval of a Rezoning related to a change from C-4 (Office Park Commercial District) to C-1A (Neighborhood Commercial District) [15705 University] G2 Melissa DeBoer, Planning Coordinator, introduced the request for approval of a rezoning for a commercial development, as requested by MDBB 1, LLC Series 4, represented by Keith Weggen of Civil Design Advantage. The property is generally located north of SE University Avenue and west of SE Waco Place, containing approximately 0.79-acres. The subject property is part of a larger parcel that was previously rezoned in 2020 from C-4/PD-1 (Office Park Commercial District with a Planned Development Overlay) to C-4 (Office Park Commercial District) and C-1A (Neighborhood Commercial District). The applicant requests to rezone a portion of the C-4 area to C-1A in order to expand the C-1A area to accommodate future development of a building intended for retail and restaurant uses. Notification to adjacent property owners was mailed on August 15, 2025. The rezoning sign was placed on the property by the August 19, 2025, deadline. Staff have not received any correspondence regarding this request. The concept plan provided shows a total of three lots and one outlot. Lot 2 includes the area proposed to be rezoned to C-1A and includes a building proposed for retail and restaurant space. Lots 1 and 3 are zoned C-4 and are shown to include one building on each of the lots proposed for office use. The outlot is shown in the northwest corner of the overall site and will be used for storm water detention. The concept plan shows one full access point provided to the overall site from SE University Avenue. This would be the only access to this site. The subject property is classified as Single-Family Residential in the Imagine Waukee 2040: Comprehensive Plan. Single Family Residential is defined as traditional forms of single-family housing with typical lot sizes ranging from 8,000 square feet to 0.50-acres in area with an average density of 2 to 4 units per acre. Although the proposed rezoning is not consistent with the Comprehensive Plan, staff are comfortable with the proposal as the proposed zoning is compatible with the existing zoning of the property as well as other properties along SE University Avenue within the vicinity of the subject property. The proposed rezoning will only slightly expand the area of the parcel zoned for C-1A, the remainder of the parcel will remain as currently zoned. Staff recommend approval of the rezoning for 15705 University. Discussion as follows: • Amanda Jorgensen, of 1410 SE Rosewood Ct, spoke on the following concerns: traffic/turn lane congestion, green space, loss of trees and air/light pollution and questioned the rezoning process, she also shared that the space seemed too small for the proposed design submitted • Andy Kass explained that the designs as presented were conceptual only and all concerns would be addressed when a site plan is submitted • Andy also confirmed that any tree removal is at the owner’s discretion; the city cannot control that • General discussion of the C-1A and C4 zoning, with C-1A zoning requiring 20% open space, and C-4 zoning requiring 25% open space • Keith Weggen, of Civil Design Advantage, spoke and reiterated information from the staff presentation that the rezoning is being requested to be compatible with the existing zoning of the property Motion by Commissioner Bannister for approval of a Rezoning related to a change from C-4 (Office Park Commercial District) to C-1A (Neighborhood Commercial District) [15705 University], seconded by Commissioner Tuel. Ayes: Beenken, Lohse, Tuel, and Bannister. Nays: None. Motion carried. STAFF REVIEW AND COMMENT: Hold the Public Hearing. RECOMMENDATION: Hold the Public Hearing. ATTACHMENTS: I. Staff Report II.
