Proposed Resolution PREPARED BY: Andy Kass, Community Development Director REVIEWED BY: PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: H2 THE CITY OF WAUKEE, IOWA RESOLUTION 2025- APPROVING THE VACATION OF PORTION OF A PUBLIC STORM SEWER EASEMENT AND A PUBLIC UTILITY EASEMENT [KETTLESTONE CENTRAL SOUTH PLAT 2] IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the City has previously approved a Public Storm Sewer Easement which exists by virtue of the plat, Kettlestone Central South Plat 2, filed on January 31, 2025, and recorded in Document Number 2025-01511, and the easement document filed on January 31, 2025, recorded in Document Number 2025-01515 (the “Easements”); AND, WHEREAS, the City has previously approved a Public Utility Easement which exists by virtue of the easement document, filed on December 31, 2012, and recorded in Book 2012, Page 23864 (the “Easements”); AND, WHEREAS, it has been determined that the Easement areas as described on attached Exhibit A are no longer needed; AND, WHEREAS, the property owner has requested that the Easement areas as described in attached Exhibit A be vacated. NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 15th day of September 2025, that it hereby approves the vacation of the portions of the Public Storm Sewer Easement and the Public Utility Easement. ____________________________ Courtney Clarke, Mayor Attest: ___________________________________ Rebecca D.
