AGENDA ITEM:Consideration of approval of a resolution approving Accounting and Consent
to Final Distribution.
FORMAT:Resolution
SYNOPSIS INCLUDING PRO & CON: City staff was recently made aware that the City was a
named beneficiary of the Duane and Doris Winters Family Trust. The bequest
is in the form of stocks which will be liquidated once they are transferred to
the City. The funds are to be used for parks facilities to serve youth and/or
seniors.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: The proposed resolution is to approve the final accounting
and consents to the final distribution of the Trust in order for the City to
receive the stocks. At a future date, a discussion will be held with the City
Council on potential uses of the funds to better the community.
RECOMMENDATION: Approve the resolution.

THE CITY OF WAUKEE, IOWA
RESOLUTION 2025-
APPROVING ACCOUNTING AND CONSENT TO FINAL DISTRIBUTION
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized
Municipal Organization; AND,
WHEREAS, the City is a beneficiary established under a Bypass Trust created by The Duane
and Doris Winters Family Trust dated December 19, 1986 (the “Trust”), as amended; AND,
WHEREAS, the City is in receipt of the final accounting of the Trust.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council approves the
final accounting and consents to the final distribution of the Trust;
BE IT FURTHER RESOLVED by the City of Waukee City Council, the Mayor or the City
Administrator are authorized to sign any and all documents necessary to receive the bequest
from the Trust on behalf of the City.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 30th day of
September, 2025.
