RESOLUTION 2025-
A RESOLUTION AUTHORIZING THE DISPOSAL OF REAL ESTATE IN
ACCORDANCE WITH IOWA CODE 364.7(2025)
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS, the City caused notice of a public hearing to be published in accordance with Iowa
Code 364.7 Code of Iowa (2025) concerning the disposal of certain real estate and gas main
easements owned by the City to MidAmerican Energy Company; AND
WHEREAS, on October 20, 2025, the Waukee City Council held a public hearing pursuant to
Iowa Code §364.7 regarding the sale and transfer of certain property interests described as:
1)Fee title in the property legally described as:
A tract of land out of the Southeast Quarter (SE¼) of Section 29, Township 79 North,
Range 26 West, in Dallas County, Iowa, described by metes and bounds as follows:
Beginning at a point in the west right of way line of a County Road
that is 293.5 feet North and 40 feet West of the Southeast corner of
Section Twenty-Nine (29); thence West 100 feet; thence Northern
153.2 feet to the Southwesterly right of way line of the property
owned by the City of Waukee (formerly Chicago Great Western
Railway); thence Southeasterly 127.8 feet along said
Southwesterly right of way line to the West right of way line of
said County Road; thence South 75 feet along the West right of
way line of said County Road to the point of beginning.
Note: The East line of the Southeast Quarter (SE¼) of Section Twenty-Nine (29) is
assumed to bear due North and South.

WHEREAS, after the public hearing, and in accordance with the Asset Purchase Agreement
between the City and MidAmerican Energy Company dated April 24, 2025 (“APA”) concerning
the sale of the Waukee Municipal Gas Utility, the City Council of the City of Waukee
determines that it is in the best interest of the City to authorize the disposal of said property to
MidAmerican Energy Company in accordance with the terms of the APA.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
20th day of October, 2025, that, following public hearing as required by Iowa Code 364.7 Code
of Iowa (2025), hereby approves the disposal of the above described property interests to
MidAmerican Energy in accordance with the APA.
BE IT FURTHER RESOLVED, that the Mayor is authorized to execute any and all documents
necessary to effect the transfer of the property interests to MidAmerican Energy Company in
accordance with the APA.
Passed by the City Council of the City of Waukee, Iowa, and approved this the 20th day of
October, 2025.
