Project, Systems Commissioning]
FORMAT:Consent Agenda
SYNOPSIS INCLUDING PRO & CON: With the remodeling of the former public safety
building and replacement of all new systems, the City is required to do commissioning to oversee
and document functional testing results of the HVAC equipment, domestic hot water, lighting
system and building automation systems. OPN Architects has coordinated with TUNE out of
Omaha to complete this work.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: $24,100
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: The Facilities Manager has reviewed this proposal and
concurs with the recommendation.

APPROVING AGREEMENT FOR PROFESSIONAL SERVICES WITH TUNE [WAUKEE
FIRE STATION NO. 91 REMODEL PROJECT, SYSTEMS COMMISSIONING]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City has hired OPN Architects to prepare plans and bid for remodeling improvements
to Fire Station No. 91 located at 1300 SE LA Grant Parkway; AND,
WHEREAS, the proposed remodeling project includes the replacement of several building systems
including HVAC, building lighting and building automation systems which require commissioning to
ensure the systems are performing as required upon installation; AND,
WHEREAS, TUNE has prepared a proposal for professional services to complete the commissioning
requirements for the new systems.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Agreement for Professional Consulting Services with TUNE [Fire Station No. 91 Remodel Project] is
hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 20th day of October, 2025.

Project description:
▪ Renovation of the Waukee PD-FD facility.
Commissioning Scope of services:
▪ Provide Commissioning services per jurisdiction (IECC 2012)
▪ Review contractor submittals applicable to the systems being commissioned.
▪ Witness applicable equipment startups.
▪ Develop functional performance testing procedures applicable to the systems being commissioned.
▪ Conduct commissioning team meetings and site observations during construction as needed.
▪ Oversee and document functional testing results for the following equipment:
o HVAC equipment
o Domestic Hot Water
o Lighting System
o Building automation system
▪ Maintain commissioning issues log and track corrective action reports.
▪ Provide a Commissioning report
o Commissioning meeting minutes
o Field Reports
o Issues Log
o Functional performance test results
Commissioning Deliverables:
▪ Commissioning summary report
▪ Compile a commissioning record notebook for Owner which includes the following:
o Commissioning meeting minutes
o Commissioning field reports
o Equipment pre-functional start-up reports
o Equipment functional performance test reports

Exclusions:
• Studies for life cycle cost analysis and energy usage
• Energy modeling for LEED or utility cost estimating
• LEED submittals or documentation
Fee basis:

Schedule:
▪ In conjunction with project.
Terms and conditions:
Tune Facilities will perform the services outlined in this agreement for the stated fee basis.
Significant changes to the scope of services initiated by the Client or project Owner will constitute a claim for a
reasonable and equitable fee adjustment. Fee adjustments will be billed on a negotiated lump sum or hourly
basis per the rate schedule below.

Invoices for Consultant services shall be payable within 30 days after the invoice date. 10 days after the Client is
paid. Past due accounts will be subject to a monthly service charge of 1.0% on the then unpaid balance.
The Client agrees that, to the fullest extent permitted by law, the Consultant’s total aggregate liability to the Client
for injuries, claims, losses, expenses, damages or claim expenses arising out of this agreement from any causes,
shall not exceed the amount the Client has in place with the Owner.
Under no circumstances will either party be liable to the other for loss of profits, revenue, or for any special,
consequential, indirect, punitive, or exemplary damages.
If a required component of the Project is omitted by Consultant from construction documents, Consultant shall not
be responsible for paying the cost required to add such item or component to the extent that such item or
component would have been required and included in the original construction documents. Client agrees that
Consultant will not be responsible for any cost or expense that provides betterment or upgrades or enhances the
value of the Project.
During the term of this Agreement and for one year after termination of this Agreement, both the Client and Tune
Facilities agree that the parties will not, without prior written consent, either directly or indirectly, solicit or attempt
to solicit, divert or hire away any person employed by the other Company.

The Consultant shall not be responsible for damages or costs resulting from hidden conditions in existing
facilities.
The Client or Consultant may terminate this agreement upon advanced written notice should the other fail to
perform its obligations hereunder. In the event of termination, the Client shall pay the Consultant for all services
rendered to the date of termination, plus all reimbursable expenses.
The Client may not use documents produced by the Consultant under this agreement for any other endeavor
without the expressed written consent of the Consultant.
