AGENDA ITEM:Consideration of approval of an ordinance to repeal Chapter 110, Natural
Gas Service Rates and Charges [introduction; first, second, third (final)
readings]
FORMAT:Ordinance
SYNOPSIS INCLUDING PRO & CON: Due to the sale of the municipal gas utility to
MidAmerican Energy Company, it is necessary to repeal Chapter 110,
Natural Gas Services Rates and Charges.
The proposed ordinance is retroactive to the date of the sale (October
22).
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: The Code of Iowa requires a vote of not less than three-
fourths of all the members of the council (or 4 out of 5, in Waukee’s
case) in order to waive readings of an ordinance.
RECOMMENDATION: Introduce the ordinance, approve the first reading in title only, waive
the second and third readings, and place the ordinance on final passage.

ORDINANCE NO. ____
AN ORDINANCE REPEALING CHAPTER 110, WAUKEE MUNICIPAL CODE,
REGARDING NATURAL GAS RATES AND CHARGES.
WHEREAS, the City transferred ownership and operation responsibility of the Waukee
Municipal Natural Gas Utility to MidAmerican Energy Company (“MEC”) on or about October 22,
2025; AND,
WHEREAS, following the transfer of the utility the rates and charges for natural gas
service within the City are established by MEC in accordance with Iowa Law and applicable
regulations; AND,
WHEREAS, the rates and charges established by the City for the natural gas utility are no
longer applicable and should be repealed.
BE IT THEREFORE ORDAINED by the City Council of the City of Waukee:
Section 1: Chapter 110, Waukee Municipal Code, Natural Gas Service Rates and
Charges, should be and the same is hereby repealed.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect from and after its final
passage, approval and publication as provided by law. The repeal of the ordinance shall be
applied retroactively to assure that no rates and charges will be charged by the City for Natural
Gas services after the transfer of ownership and operation of the Waukee Natural Gas Utility to
MidAmerican Energy Company in accordance with the Asset Purchase Agreement.
