HomeMy WebLinkAbout2025-12-15 H01 Property Disposal, Parcel 25-8 and 25-27 AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: December 15, 2025 AGENDA ITEM: Consideration of approval of a resolution approving the vacation and disposal of public property pursuant to Iowa Code Sections 354.23 and 364.7 (2025) [Parcel 25-8 & Parcel 25-27] FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: Parcels 25-8 and 25-27 are located west of Grand Prairie Parkway and north of Interstate 80. The properties were acquired for the construction of the Grand Prairie Parkway interstate interchange and are no longer needed for right-of-way purposes. Kettlestone Lakes, LLC, the developer of the Kettlestone Lakes project to the west of Parcels 25-8 and 25-27, submitted an offer to the city to purchase the property and combine it into their mixed-use development. The purchase offer provided is $78,600. The offer is based on an appraisal that was conducted by the city for the excess right-of-way. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the vacation and disposal of Parcel 25-8 and Parcel 25-27. Real Estate Purchase Agreement PREPARED BY: Andy Kass, Community Development Director REVIEWED BY: H1 THE CITY OF WAUKEE, IOWA RESOLUTION 25- A RESOLUTION AUTHORIZING THE DISPOSAL OF REAL ESTATE IN ACCORDANCE WITH IOWA CODE 364.7(2025) IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Iowa is a duly organized municipality within Dallas County; AND, WHEREAS, the City caused notice of a public hearing to be published in accordance with Iowa Code 364.7 Code of Iowa (2025) concerning the disposal of certain real estate owned by the City to Kettlestone Lakes, LLC; AND WHEREAS, on December 15, 2025, the Waukee City Council held a public hearing pursuant to Iowa Code §364.7 regarding the sale and transfer of certain property interests described as: Parcel 25-27(Plat of survey recorded at Bk 2025 Page 12463) legally described as: A part of Parcel 19-115 as shown on the Plat of Survey recorded in Book 2019 Page 24199 in the City of Waukee, Dallas County, Iowa and more particularly described as follows: Beginning at the Northwest Corner of said Parcel 19-115; thence North 77°25’23” East along the North line of said Parcel 19-115, a distance of 328.51 feet to the Southwest corner of Parcel 24-125 as shown on the Plat of Survey recorded in Document Number 2024-20030; thence South 02°21’38” East along the West line of Parcel 25-8 as shown on the Plat of Survey recorded in Document Number 2025- 12449, a distance of 98.94 feet to the Southwest Corner of said Parcel 25-8; thence South 83°39’14” West, 339.99 feet to the West line of said Parcel 19-115; thence North 11°30’00” East along said West line, 66.23 feet to the point of beginning and containing 0.61 acres (26,710 square feet). AND Parcel 25-8(Plat of survey recorded at Bk 2025 Page 12449) legally described as: A part of Parcel 19-115 as shown on the Plat of Survey recorded in Book 2019 Page 24199 in the City of Waukee, Dallas County, Iowa and more particularly described as follows: Beginning at the Northeast Corner of said Parcel 19-115; thence Southerly along the Easterly line of said Parcel 19-115 and a curve concave Westerly whose radius is 4822.00 feet, whose arc length is 42.98 feet and whose chord bears South 00°26’27” West, 42.98 feet; thence South 28°47’37” West along said Easterly line, 123.15 feet; thence South 87°38’22” West, 208.16 feet; thence North 02°21’38” West, 98.94 feet to the North line of said Parcel 19-115 and the Southwest Corner of Parcel 24-125 as shown on the Plat of Survey recorded in Document Number 2024-20030; thence North 77°25’23” East along said North line, 278.38 feet to the point of beginning and containing 0.69 acres (30,247 square feet). WHEREAS, after the public hearing, and in accordance with the Purchase Agreement between the City and Kettlestone Lakes, LLC dated December 15, 2025 concerning the transfer of property to Kettlestone Lakes, LLC, the City Council of the City of Waukee determines that it is in the best interest of the City to authorize the disposal of said property to Kettlestone Lakes, LLC in accordance with the terms of the Purchase Agreement. NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 15th day of December, 2025, that, following public hearing as required by Iowa Code 364.7 Code of Iowa (2025), hereby approves the disposal of the above described property interests to Kettlestone Lakes, LLC in accordance with the Purchase Agreement. BE IT FURTHER RESOLVED, that the Mayor is authorized to execute any and all documents necessary to effect the transfer of the property interests to Kettlestone Lakes, LLC in accordance with the Purchase Agreement.
