HomeMy WebLinkAbout2025-12-15 I04 Chapter 70, Parking Violations_INTRO, 1ST READAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: December 15, 2025 AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 70, Traffic Code Enforcement Procedures, by amending Section 70.03, Parking Violations: Alternate, to amend fees [introduction; first reading] FORMAT:Ordinance SYNOPSIS INCLUDING PRO & CON: Police Department staff have identified a conflict between Waukee City Code and Iowa State Code related to fines for improper use of a persons with disabilities parking permit. Iowa State Code 321L.4 defines “improper use of a persons with disabilities parking permit.” The fines for violations of this Code are set as a scheduled fine of two hundred dollars ($200) in Iowa Code 805.8A(1)(c), however City of Waukee Code 70.03 sets these fines at one hundred dollars ($100). Additionally, the Police Department is proposing to align all other parking fines at $35. Currently, snow ordinance citations are $25 and all other parking violations are $10. A late fee, if the fine is not paid within 30 days, is incurred at a rate of $5. This change would create consistency among parking citations and aligns with current City of Urbandale practices. Additionally, recently Dallas County has started charging $5 to release holds on unpaid parking citations which must be paid from the Police Department budget once late fines are paid. The increase will cover the additional expense incurred by the Police Department for the late fees when payments must be made to Dallas County. The Police Department surveyed other west metro agencies and found the following fine / fee structures for parking citations: Clive - $15 Parking / $25 Snow Ordinance Urbandale - $35 Parking / $35 Snow Ordinance West Des Moines - $15 Parking / $50 Snow Ordinance Windsor Heights - $10 Parking / $25 Snow Ordinance FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: Minimal fiscal impact in revenues, but offsets minor expenses surrounding releases of holds for parking citations not paid when someone renews their registration. AN ORDINANCE TO AMEND CHAPTER 70, TRAFFIC CODE ENFORCEMENT PROCEDURES, BY AMENDING SECTION 70.03, PARKING VIOLATIONS: ALTERNATE, TO AMEND FEES WHEREAS, the City of Waukee maintains a Traffic Code, the provisions of which this Traffic Code and State law relating to motor vehicles and law of the road are enforced by the officers of the Police Department; AND, WHEREAS, fines related to certain specific notices for parking violations are hereby amended; BE IT THEREFORE ORDAINED by the City Council of the City of Waukee: Section 1. Chapter 70, Traffic Code Enforcement Procedures, Section 70.03, Parking Violations: Alternate, is hereby amended as follows: 70.03 PARKING VIOLATIONS: ALTERNATE. Uncontested violations of parking restrictions imposed by this Code of Ordinances shall be charged upon a simple notice of a fine payable at the office of the City Clerk. The simple notice of a fine shall be in the amount of $35.00 for snow route parking violations and all other parking violations, except improper use of a persons with disabilities parking permit. If such fine is not paid within 30 days, it shall be increased by $5.00. The simple notice of a fine for improper use of a persons with disabilities parking permit is $200.00. Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provisions or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
