HomeMy WebLinkAbout2025-12-15 I05 Snow Emergency Ordinance_INTRO, 1ST-3RD READAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: December 15, 2025 AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 68, Parking Regulations, City of Waukee, Iowa, by amending Section 68.14(1), Snow Emergency [introduction; first, second, third (final) readings] FORMAT:Ordinance SYNOPSIS INCLUDING PRO & CON: Ordinance Chapter 68, section 68.14(1) is amended to clarify the duration of parking prohibitions during a snow emergency to assist police in enforcing parking ticket violations. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: The Code of Iowa requires a vote of not less than three- fourths of all the members of the council (or 4 out of 5, in Waukee’s case) in order to waive readings of an ordinance. RECOMMENDATION: Introduce the ordinance, approve the first reading in title only, waive the second and third readings, and place the ordinance on final passage. ATTACHMENTS: I. AN ORDINANCE TO AMEND CHAPTER 68, PARKING REGULATIONS, BY AMENDING SECTION 68.14(1), SNOW EMERGENCY WHEREAS, the City of Waukee maintains regulations related to proclamations of a snow emergency by the Public Works Director and the prohibition of parking vehicles on public streets during such snow emergencies; AND, WHEREAS, Section 68.14, Snow Emergency, is hereby amended to clarify the duration of parking prohibitions during a snow emergency; BE IT THEREFORE ORDAINED by the City Council of the City of Waukee: Section 1. Chapter 68, Parking Regulations, Section 68.14(1), Snow Emergency, is hereby amended as follows: 68.14 SNOW EMERGENCY. 1. No person shall park, abandon, or leave unattended any vehicle on any public street, alley, or City-owned off-street parking area during a snow emergency proclaimed by the Public Works Director. A snow emergency parking ban shall continue from its proclamation through the duration of the snow or ice storm and the 24-hour period after cessation of such storm or until the Public Works Director suspends the snow emergency parking ban. (Code of Iowa, 321.236[1]) Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provisions or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
