AGENDA ITEM:Consideration of approval of a resolution ordering construction of the
Alice’s Road Improvements Phase 1B and fixing a date for hearing
thereon and taking bids therefor.

SYNOPSIS INCLUDING PRO & CON: This project includes all materials, equipment,
transportation and labor necessary to reconstruct Alice’s Road, from south of Dellwood Drive to south
of Douglas Parkway, from a two-lane rural section to a four-lane boulevard section including PCC
pavement, PCC trail and pedestrian ramps. Project items include subgrade preparation and treatment,
PCC roadway paving, trail and ramp paving, pavement markings, storm sewer installation, water
main installation, Joint Utility Trench (JUT) installation, traffic control, erosion control, landscaping,
plantings, and surface restoration. Specific project location along with the kind and approximate
quantity of materials to be used shall be as set forth in the Plans and Specifications. This is a joint
project between the Cities of Clive and Waukee with the City of Clive acting as the project
administrator. Sealed bids must be filed before 2:00 p.m. on February 5th, 2026 in the office of the
Clive City Clerk.

RESOLUTION 2026-
RESOLUTION ORDERING CONSTRUCTION OF THE
ALICE'S ROAD IMPROVEMENTS PHASE 1B, AND FIXING A
DATE FOR HEARING THEREON AND TAKING OF BIDS
THEREFOR
WHEREAS, it is deemed advisable and necessary to construct certain public improvements
as a joint project with the City of Clive described in general as the Alice's Road Improvements
Phase 1B; and
WHEREAS, the City of Clive will serve as the lead agency for the Project and will enter
into the construction contract for the Project; and
WHEREAS, the City of Clive has caused to be prepared plans, specifications and form of
contract, together with estimate of cost, which are now on file in the office of the Waukee City
Clerk for public inspection, for the construction of the public improvements; and
WHEREAS, the plans, specifications and form of contract are deemed suitable for the
making of the public improvements; and
WHEREAS, final grades have been established by ordinance, consistent with the plans for
all street improvements included in the proposed construction; and
WHEREAS, before the plans, specifications, form of contract and estimate of cost may be
adopted, and a contract for the construction of the public improvements is entered into, it is
necessary, pursuant to Chapter 26, Code of Iowa, to hold a public hearing and to advertise for bids:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WAUKEE, STATE OF IOWA:
Section 1.That it is hereby determined that it is necessary and advisable to construct certain
public improvements described in general as the Alice's Road Improvements Phase 1B, in the
manner set forth in the plans and specifications and form of contract, above referred to, the cost
thereof to be paid in accordance with the provisions as set out in the posted Notice to Bidders and
published Notice of Public Hearing; the public improvements being more generally described as
follows:
This project includes all materials, equipment, transportation and labor necessary
to reconstruct Alice’s Road, from south of Dellwood Drive to south of Douglas
Parkway, from a two-lane rural section to a four-lane boulevard section including
PCC pavement, PCC trail and pedestrian ramps. Project items include subgrade
preparation and treatment, PCC roadway paving, trail and ramp paving, pavement
markings, storm sewer installation, water main installation, Joint Utility Trench
(JUT) installation, traffic control, erosion control, landscaping, plantings, and
surface restoration. Specific project location along with the kind and approximate
quantity of materials to be used shall be as set forth in the Plans and Specifications.
Section 2.That the amount of the bid security to accompany each bid shall be in an amount
which shall conform to the provisions of the notice to bidders approved as a part of the
specifications.
BE IT FURTHER RESOLVED, that the City Clerk be and is hereby directed to post a
notice to bidders once in a relevant contractor plan room service with statewide circulation and a
relevant construction lead generating service with statewide circulation and on an internet site
sponsored by either the City or a statewide association that represents the City. Posting shall be
not less than thirteen clear days nor more than forty-five days prior to February 5, 2026, which is
hereby fixed as the date for receiving bids. The bids are to be filed prior to 2:00 P.M., on such
date.
The City Council hereby delegates to the designated representative for the City of Clive,
as determined by the City Council of the City of Clive, the duty of receiving, opening and
tabulating bids for construction of the Project. Bids shall be received and opened as provided in
the public notice and the results of the bids shall be considered at the meeting of this Council on
February 17, 2026, at 5:30 P.M.
BE IT FURTHER RESOLVED, that the City Clerk be and is hereby directed to publish
notice of hearing once in a legal newspaper, printed wholly in the English language, published at
least once weekly and having general circulation in this City. Publication shall be not less than
four clear days nor more than twenty days prior to the date hereinafter fixed as the date for a public
hearing on the plans, specifications, form of contract and estimate of costs for the project, the
hearing to be at 5:30 P.M. on February 17, 2026.

NOTICE TO BIDDERS AND NOTICE OF PUBLIC HEARING
CITY OF CLIVE AND CITY OF WAUKEE
ALICE’S ROAD IMPROVEMENTS PHASE 1B
Time and Place for Filing Sealed Proposals. Sealed bids for the work comprising each improvement as
stated below must be filed before 2:00 p.m. on February 5th, 2026 in the office of the City Clerk, (Note location
for filing of sealed bids is different than in previous years due to construction at City Hall) Clive

Time and Place Sealed Proposals Will be Opened and Considered. Sealed proposals will be opened, and
bids tabulated at 2:00 p.m. on February 5th, 2026, (Note location for opening of bids is different than in
previous years due to construction at City Hall) in the Community Room of the Clive Harbach Center,
8505 Harbach Blvd., for consideration by the Clive City Council at its meeting at 6:00 p.m. on February 12th,
2026 in the Council Chambers of Clive City Hall, 1900 NW 114th Street, Clive, Iowa. Bids will be presented
for consideration by the Waukee City Council at its meeting at 5:30 p.m. on February 17th, 2026 in the Council
Chambers of the Waukee City Hall, at 230 Hickman Road, Waukee, Iowa. The City of Clive and City of
Waukee reserve the right to reject any and all bids. Bids and award of contract must be approved by the City
Council of each City.
The City of Clive in accordance with Title VI of the Civil Rights Act of 1964, Stat. 252, 42 U.S.C. 2000d to
2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the
Secretary, Part 21, Nondiscrimination in Federally assisted programs of the Department of Transportation
issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract
entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to
submit bids in response to this invitation and will not be discriminated against on the grounds of race, color,
national origin, sex, age, or disability in consideration for award.
Time for Commencement and Completion of Work. Work on the improvements shall commence on or
before the date specified in a written Notice to Proceed. The anticipated date for written Notice to Proceed is
April 15, 2026. Work on the project shall be substantially complete per the following schedule:
1.All work on the project, except median plantings, shall be completed by September 30th, 2026, and
the project open to vehicular and pedestrian traffic.
2.Median plantings shall be completed by November 25th, 2026
Liquidated damages for noncompliance with said completion provisions will be assessed at the rate of One
Thousand Five Hundred Dollars ($1,500.00) for each calendar day thereafter that the work remains
incomplete.
Bid Security. Each bidder shall accompany its bid with bid security as defined in Section 26.8 of the Iowa
Code and as outlined in the Instruction to Bidders in an amount equal to Ten (10) percent of the total bid
amount.
Contract Documents. Bidding forms may be obtained from SNYDER & ASSOCIATES, INC., 2727
SW SNYDER BLVD., ANKENY, IA 50023. Copies of Plans and Specifications and contract documents

Public Hearing on Proposed Contract Documents and Estimated Costs for Improvement.
Proposed contract documents are subject to approval after public hearing by the city council of Clive and the
city council of Waukee.
A public hearing will be held by the Clive City Council on the proposed contract documents (plans,
specifications and form of contract) and estimated cost for the improvements, as bid by the selected bidder, at
its meeting at 6:00 pm on February 12th, 2026, in said Council Chambers of the City Hall, 1900 NW 114th
Street, Clive, Iowa.
A public hearing will be held by the Waukee City Council on the proposed contract documents (plans,
specifications and form of contract) and estimated cost for the improvements, as bid by the selected bidder, at
its meeting at 5:30 pm on February 17th, 2026, in said Council Chambers of the City Hall, 230 Hickman Road,
Waukee, Iowa. In accordance with Iowa Code Sections 21.4(1)(b) and 21.8, this meeting of the Waukee City
Council will be conducted with two different options for public participation: 1) Members of the public
wishing to attend in person may do so in the Council Chambers at Waukee City Hall. 2) Members of the

Preference of Products and Labor. Preference shall be given to domestic construction materials by the
contractor, subcontractors, material, men and suppliers in performance of the contract and, further, by virtue
of statutory authority, preference will be given to products and provisions grown and coal produced within
the State of Iowa, and to Iowa domestic labor, to the extent lawfully required under Iowa statutes.
Resident Bidder Preference Law. Iowa Code 73A.21 outlines the reciprocal resident bidder and labor
force preference statute. The Iowa Department of Labor (DOL) has adopted administrative rules to enforce
this law. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being
deemed nonresponsive and rejected.
Sales Tax. The bidder shall not include sales tax in the bid. The City of Clive will distribute tax exemption
certificates and authorization letters to the Contractor and all Subcontractors who are identified. The
Contractor and Subcontractors may make copies of the tax exemption certificates and provide a copy to each

supplier providing construction materials. These tax exemption certificates and authorization letters are
applicable only for this specific project under the Contract.
