HomeMy WebLinkAbout2025-12-15 Resolution 2025-503_Release and Satisfaction for Development Agreement, Indi Run West LLCTHE CITY OF WAUKEE, IOWA RESOLUTION 2025-503 APPROVING A RELEASE AND SATISFACTION FOR DEVELOPMENT AGREEMENT — INDI RUN WEST, LLC IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, Indi Run West, LLC, (collectively "Property Owners") entered into a Development Agreement ("Agreement") with the City of Waukee, dated May 16, 2022, and recorded on May 20, 2022, in Book 2022 Page 11278, Dallas County, Iowa regarding development of NW Douglas Parkway. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa that the terms of the Agreement have been satisfied and the City releases the Property Owners and their successors and assigns, from all obligations under said Developers Agreement as it pertains to the following legally described area: ALL OF 01.11LOT 'T. THE COMMONS AT GREENWAY PLAT 1, AN OFFICIAL PLAT IN THE GITY OF WAUKEE. DALLAS COUNTY. IOWA. AND A PART OF THE SOUTHWEST QUARTER AND A PART OF THE SOUTHEAST QUARTER IN SECTION 28, TOWNSHIP 79 NORTH. RANGE 28 WEST OF THE FIFTH PRINCIPAL MERIDIAN IN THE CITY OF WAUKEE, DALLAS COUNTY. IOWA AND ALL BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF INDI RUN PLAT 2, AN OFFICIAL PLAT IN SAID CITY OF WAUKEE; THENCE SOUTH 13'06'10" WEST ALONG THE WESTERLY LINE OF SAID INDI RUN PLAT 2, A DISTANCE OF 473.87 FEET; THENCE SOUTH 0737'01" WEST CONTINUING ALONG SAID WESTERLY LINE, 407.48 FEET; THENCE SOUTH 3521'35' WEST CONTINUING ALONG SAID WESTERLY LINE. 41.30 FEET TO A CORNER ON THE WESTERLY LINE OF OUTLOT 'W.
