RESOLUTION 2026-012
APPROVING A PARTIAL RELEASE AND SATISFACTION FOR DEVELOPMENT
AGREEMENT — CALIBER LAND COMPANY, LLC
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Caliber Land Company, LLC, and AP North, L.C. (collectively "Property
Owners") entered into a Development Agreement ("Agreement") with the City of Waukee, dated
May 15, 2023, and recorded on May 24, 2023, in Book 2023 Page 6903, Dallas County, Iowa
regarding development of SE Tallgrass Lane.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa
that the terms of the Agreement have been partially satisfied and the City releases the Property
Owners and their successors and assigns, from all obligations under said Developers Agreement
as it pertains to the following legally described area:
Lot 2 of Kettlestone Central South Plat 4
Passed by the City Council of the City of Waukee, Iowa, and approved this the 5th day of January
2026.
