HomeMy WebLinkAbout2026-01-19 H01 Annexation_Hubbell, New Pioneer Gun Club AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: January 19, 2026 AGENDA ITEM: Consideration of approval of a resolution approving the annexation of property by the City of Waukee, Iowa FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: Staff has received voluntary annexations applications from Hubbell Realty Company and The New Pioneer Gun Club. The property is generally located south of Westown Parkway and west of SE L.A. Grant Parkway. The total acreage of consenting property is 100.43-acres of consenting property. The current uses of the properties are for agricultural purposes and for a private shooting range. The City initially included the annexation of non-consenting property, a 0.75- acre parcel that adjoins the consenting properties, owned by Jerome A. Aldrich as part of the annexation request as allowed by Iowa Code Chapter 368. After discussions with the City Development Board regarding concerns that the City Development Board raised regarding the annexation of the non- consenting property, staff believe it is in the best interest of the city to remove the non-consenting property from the annexation and proceed forward with annexation of the consenting property owners. Staff is recommending proceeding forward with the annexation of the consenting properties which includes a total of approximately 100.43-acres. Proposed Resolution PREPARED BY: Andy Kass, Community Development Director REVIEWED BY: PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: H1 DATE OF PUBLICATION: THE CITY OF WAUKEE, IOWA RESOLUTION 2026- RESOLUTION APPROVING THE ANNEXATION OF PROPERTY WHEREAS, the City of Waukee, State of Iowa, is a duly organized municipal corporation, and; WHEREAS, the City of Waukee, Iowa has received an Application for Voluntary Annexation for property owned by Hubbell Realty Company, which is located south of Westown Parkway and approximately one-quarter mile west of SE L.A. Grant Parkway within Dallas County, Iowa, and shown on the map identified as Exhibit “A” attached hereto and made a part hereof and legally described on Exhibit “B” and; WHEREAS, the City of Waukee, Iowa has received an Application for Voluntary Annexation for property owned by The New Pioneer Club, which is located south of Westown Parkway and approximately one-quarter mile west of SE L.A. Grant Parkway within Dallas County, Iowa, and shown on the map identified as Exhibit “A” attached hereto and made a part hereof and legally described on Exhibit “B” and; WHEREAS, pursuant to Iowa Code Chapter 368.7 in order to avoid creating an island and to create more uniform boundaries, the City of Waukee, Iowa included non-consenting property as shown on the map identified as Exhibit “C” attached hereto and legally described on Exhibit “D” as part of the annexation but, after public hearing, determines that including the non-consenting property as part of the annexation is not in the public interest at this time and the non-consenting property should be removed from the annexation and; WHEREAS, the City Development Board allows for amendment upon request/motion by the City; and WHEREAS, the Council authorizes the City Attorney and City Staff seek an amendment to correct the legal description by deleting/removing any parcel as necessary through amendment; WHEREAS, the property that is the subject of the voluntary annexation applications collectively adjoins the City as required by Chapter 368, Code of Iowa, 2026, and; WHEREAS, all required notification has been carried out pursuant to Chapter 368, code of Iowa, 2026, and; WHEREAS, a public hearing was held concerning said applications and the annexation on January 19, 2026, as required by law. WHEREAS, after public hearing the City Council of the City of Waukee determines it is in the best interests of the City, and the public, that the property that is the subject of the voluntary annexation applications be annexed to the City of Waukee, at this time. BE IT THEREFORE RESOLVED, by the City Council of the City of Waukee as follows: SECTION 1. The Annexation of property is hereby approved and said property described in Exhibit “B” shall be annexed to the City of Waukee Iowa, in accordance with Chapter 368, code of Iowa, 2026, and such property shall hereinafter become and be part of the City of Waukee, Iowa. SECTION 2. The Mayor and the City Clerk are hereby authorized and directed to prepare and execute all documents necessary for this annexation and are directed to file the same as required by the Code of Iowa. SECTION 3. The City Council approves amendment to Petition for Annexation referenced above and authorizes and directs the City Attorney, City Administrator, Mayor, staff and representatives to take all action necessary, including requesting an amendment to modify the legal description for the State of Iowa City Development Board and to take all further action to finalize this annexation including preparing and executing any necessary documents and any filings with the City Development Board of the State of Iowa and participating in any related hearings and proceedings.
