Hickman Rd. and electronically via Zoom. (B) Pledge of Allegiance (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Kala Anderson, Chris Crone, Rob Grove, Lori Lyon, Anna Bergman Pierce. Absent: None. Also in attendance: City Administrator Brad Deets, Assistant City Administrator Nick Osborne, Retiring Finance Director Linda Burkhart, Finance Director Rachel Downing, Community Development Director Andy Kass, Planning Coordinator Melissa DeBoer, Public Works Director/City Engineer Rudy Koester, Director of Human Resources Michelle Lindsay, Director of Economic Development Jennifer Brown, Director of Marketing & Communications Heather Behrens (electronically), Police Chief Chad McCluskey, City Clerk Rebecca D. Schuett, City Attorney Steve Brick. (D) Open Forum – 1) Veronica Lack, Dallas County Soil and Water Commissioner, spoke on water quality concerns, marking methane pipelines in the community, and backflow valve issues at her residence. (E) Agenda Approval – Council Member Crone moved to approve the agenda; seconded by Council Member Grove. Results of vote: Ayes: Anderson, Crone, Grove, Lyon, Pierce. Nays: None. Motion carried 5 – 0. (F) Presentations: 1) Independent Auditor’s Final Report for the fiscal year ending June 30, 2025 – Presentation made by Robert Endriss with Denman & Co. 2) Resolution: Consideration of approval of the Independent Auditor’s Final Report for the fiscal year ending June 30, 2025 – Council Member Pierce moved to approve the resolution; seconded by Council Member Grove. Retiring Finance Director Burkhart briefly reviewed staff response to the audit report. Results of vote: Ayes: Anderson, Crone, Grove, Lyon, Pierce. Nays: None. Motion carried 5 – 0. (Resolution #2026-024) (G) Public Hearings: 1) On the annexation of consenting and non-consenting properties by the City of Waukee, Iowa [Hubbell Realty Company/New Pioneer Gun Club/Jerome Aldrich] – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Community Development Director Kass reviewed the proposed annexation, noting that voluntary annexation petitions were submitted by Hubbell Realty Company and New Pioneer Gun Club; the Aldrich property is non-consenting. The parcels are part of the City’s future land use map and the Dallas County Auditor has confirmed the legal descriptions; hearing notices were mailed as required by State Code. Mr. Kass stated that after discussions with the City Development Board, the Aldrich property did not meet the criteria for annexation to avoid creating an island; therefore, City staff recommend moving forward with annexation of the two consenting properties only. Mayor Clarke invited public comment: 1) Veronica Lack, Dallas County Soil and Water Commissioner, expressed concern about unmarked methane pipelines; Mayor Clarke stated such comments did not pertain to this public hearing. Council Member Lyon asked for clarification on which properties were consenting and non- consenting. 2) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to C-1, a parcel to be known as Orange Commercial Development – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Community Development Director Kass reviewed the proposed I1B 2 rezoning application. Hearing notices were mailed as required by State Code; no correspondence was received either in support of or against the rezoning. A development concept plan shows a retail/grocery store and convenience store/fueling station, with two outlots along Hickman Rd. for future development. Mr. Kass reviewed the concept plan landscape buffers and site ingress/egress. A traffic study for the area was conducted as part of an earlier Alice’s Rd. design. The parcel is shown as a Mixed Use Corridor in the City’s Comprehensive Development Plan. Mayor Clarke invited public comment: 1) Veronica Lack, Dallas County Soil and Water Commissioner, expressed concern about unmarked methane pipelines; Mayor Clarke replied that all utility lines are marked prior to construction. Council Member Lyon asked if any extra turn lanes would be constructed along Hickman Rd.; Mr. Kass answered that the Iowa Department of Transportation (IDOT) has predetermined access points along Hickman Rd. 3) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to K-RC, a parcel to be known as B. Krumm Farms – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Planning Coordinator DeBoer reviewed the proposed rezoning application for properties within the Kettlestone Corridor. Hearing notices were mailed as required by State Code; no correspondence was received either in support of or against the rezoning. There is no development concept plan, as the owner intends to sell the property. Mayor Clarke invited public comment; no comments were made by the public in attendance. 4) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from C-1A to C-1, a parcel to be known as WCSD Admin Building Expansion – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Planning Coordinator DeBoer reviewed the proposed rezoning application. In order to construct an addition to the Waukee Community School District administration building, the subject property must be within the same zoning district. City staff received one phone call from a resident concerned that the onsite regional detention pond would be removed; however, the pond will remain and be owned and maintained by the school district. Ms. DeBoer reviewed the development concept plan, noting that the parcel is within the Kettlestone Master Plan area. Mayor Clarke invited public comment: 1) Veronica Lack, Dallas County Soil and Water Commissioner, expressed concern about unmarked methane pipelines; Mayor Clarke stated such comments did not pertain to this public hearing. 5) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from R-4/PD-1 to R-4/PD-1, a parcel known as Vintage Estates of Waukee – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied that none had been received in the clerk’s office. Planning Coordinator DeBoer reviewed the proposed rezoning application for a parcel within the Kettlestone Corridor. The proposed amendment to the existing planned development overlay would allow the property to be subdivided into separate lots. Hearing notices were mailed as required by State Code; no correspondence was received either in support of or against the rezoning. The development concept plan shows 30 detached villa-style townhomes, a pool and a gazebo; the original development included 29 units on one lot, as well as a clubhouse. The outlot will be owned and maintained by a homeowners association; the interior street will remain private. Mayor Clarke invited public comment; no comments were made by the public in attendance. Council Member Crone asked if the developer would finish construction of the existing units; Ms. DeBoer replied in the affirmative, as long as inspections allowed for it. (H) Public Hearing Action Items: 1) Resolution: Consideration of approval of a resolution approving the annexation of property by the City of Waukee, Iowa – Council Member Crone moved to approve the resolution; seconded by Council Member Grove. Community Development Director Kass reiterated that the proposed resolution approved the annexation of the consenting properties 3 only. Results of vote: Ayes: Anderson, Crone, Grove, Lyon, Pierce. Nays: None. Motion carried 5 – 0. City staff then reviewed proposed FY2027 general fund revenue sources, program expenditures, staffing change recommendations, general fund expenditures, contractual services and capital equipment. The proposed budget includes maintaining the $12.80/$1,000 tax levy rate. Matt Stoffel (participating electronically) and Carrie Swartz with PFM Financial Advisors, LLC, reviewed utility fund analyses, recommending increases in water, wastewater, storm water and solid waste rates.
