AGENDA ITEM:Consideration of approval of a resolution ordering construction of the
Waukee City Building Project (410 6th Street) and fixing a date for
hearing thereon and taking of bids therefor

SYNOPSIS INCLUDING PRO & CON: This project includes the demolition of an existing city
building located at 410 6th St., Waukee, IA that is approximately 1,775
square feet as well as the demolition of two outbuildings with the
approximate square footage of 120 SF and 100 SF. A new community center
will be built in the same location and within a similar footprint to the old
building. The new community center is currently shown to be approximately
2,700 gross square feet and is one story.
Sealed bids must be filed before 2:00 p.m. on March 3, 2026. The results
of the bids shall be considered at the meeting of this Council on March 16,
2026.

RESOLUTION 2026-
RESOLUTION ORDERING CONSTRUCTION OF THE
WAUKEE CITY BUILDING PROJECT, AND FIXING A DATE
FOR HEARING THEREON AND TAKING OF BIDS
THEREFOR
WHEREAS, it is deemed advisable and necessary to construct certain public improvements
described in general as the Waukee City Building Project; and
WHEREAS, the City has caused to be prepared plans, specifications and form of contract,
together with estimate of cost, which are now on file in the office of the City Clerk for public
inspection, for the construction of the public improvements; and
WHEREAS, the plans, specifications and form of contract are deemed suitable for the
making of the public improvements; and
WHEREAS, before the plans, specifications, form of contract and estimate of cost may be
adopted, and a contract for the construction of the public improvements is entered into, it is
necessary, pursuant to Chapter 26, Code of Iowa, to hold a public hearing and to advertise for bids:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WAUKEE, STATE OF IOWA:
Section 1.That it is hereby determined that it is necessary and advisable to construct certain
public improvements described in general as the Waukee City Building Project, in the manner set
forth in the plans and specifications and form of contract, above referred to, the cost thereof to be
paid in accordance with the provisions as set out in the posted Notice to Bidders and published
Notice of Public Hearing; the public improvements being more generally described as follows:
Demolition of an existing city building located at 410 6th St., Waukee, IA that is
approximately 1,775 square feet as well as the demolition of two outbuildings with
the approximate square footage of 120 SF and 100 SF. A new community center
will be built in the same location and within a similar footprint to the old building.
The new community center is currently shown to be approximately 2,700 gross
square feet and is one story.
Section 2.That the amount of the bid security to accompany each bid shall be in an amount
which shall conform to the provisions of the notice to bidders approved as a part of the
specifications.
BE IT FURTHER RESOLVED, that the City Clerk be and is hereby directed to post a
notice to bidders once in a relevant contractor plan room service with statewide circulation and a
relevant construction lead generating service with statewide circulation and on an internet site
sponsored by either the City or a statewide association that represents the City. Posting shall be
not less than thirteen clear days nor more than forty-five days prior to March 3, 2026, which is
hereby fixed as the date for receiving bids. The bids are to be filed prior to 2:00 P.M., on such
date.
The City Council hereby delegates to the City Administrator or his designee the duty of
receiving, opening and tabulating bids for construction of the Project. Bids shall be received and
opened as provided in the public notice and the results of the bids shall be considered at the meeting
of this Council on March 16, 2026, at 5:30 P.M.
BE IT FURTHER RESOLVED, that the City Clerk be and is hereby directed to publish
notice of hearing once in a legal newspaper, printed wholly in the English language, published at
least once weekly and having general circulation in this City. Publication shall be not less than
four clear days nor more than twenty days prior to the date hereinafter fixed as the date for a public
hearing on the plans, specifications, form of contract and estimate of costs for the project, the
hearing to be at 5:30 P.M. on March 16, 2026.

NOTICE OF BID LETTING
1.1 CONTRACTORS: NOTICE OF PUBLIC BID LETTING FOR THE WAUKEE CITY PROJECT,
WAUKEE, IOWA AND THE TAKING OF BIDS THEREFORE.
A. NOTICE IS HEREBY GIVEN: BIDS FOR THE WAUKEE CITY BUILDING PROJECT WILL BE
ACCEPTED FOR REVIEW AND CONSIDERATION.
B. Sealed bids for the Waukee City Building Project will be received on March 3, 2026, at the
Waukee City Hall, located at 230 W Hickman Rd, Waukee, IA 50263, before 2:00 PM, CST,
according to the designated clock in the Administrative Office. The Proposals will be publicly
opened and read at 2:00 PM, CST at the Waukee City Hall, located at 230 W Hickman Rd,
Waukee, IA 50263. Neither the Owner nor its agents will assume liability for the inability of a
bidder to submit a bid in a timely manner. Bidders bear full and complete responsibility for the
timely submission of such bid. Bids received after the deadline will be rejected.
C. Scope of work includes but is not limited to the following: Demolition of an existing city building
located at 410 6th St. Waukee, IA that is approximately 1,775 square feet as well as the
demolition of two outbuildings with the approximate square footage of 120 SF and 100 SF. A
new community center will be built in the same location and within a similar footprint to the old
building. The new community center is currently shown to be approximately 2,700 gross
square feet and is one story.
1.2 CONTRACTS
A. Bids will be received, and the project constructed under a single prime contract. Bids must be
on a lump sum basis. Work to commence on or about April 15, 2026 and be substantially
complete on or before March 15, 2027. Final Acceptance of the Project shall be on or before
March 19, 2027.
1.3 DOCUMENT AVAILABILITY
A. Bid documents will be available for viewing at Waukee City Hall, 230 W Hickman Rd, Waukee,
IA 50263, and at the following websites:
1. Waukee City Website, www.waukee.org
2. Master Builders of Iowa Construction Update, www.iowaconstructionupdate.com or
www.mbi.build.
B. Complete sets of bidding documents are available from Action Reprographics, (515) 288-
2146. Bidders may contact Action Reprographics and visit their website
(www.actionrepro.com) to order the Bid Documents. A $100.00 deposit or current MBI/ABC
Plans Request Card, made payable to the City of Waukee is required which will provide for a
complete paper copy of the drawings and Project Manual specifications. Any shipping and
handling costs are the responsibility of the bidder. Bidders have the option to download
electronic Specifications and Drawings in lieu of the paper copy. Plan deposits will be
refunded upon the return of the documents, in reusable condition to Action Reprographics
within 14 days after the award of the project. Failure to comply will result in the forfeiture of the
plan deposit.

1.4 BIDDING REQUIREMENTS
A. Each Bid shall be submitted on the Bid Form provided with the Bidding Documents. No oral,
facsimile, or telephonic bids or modifications will be considered. Bids shall be addressed and
delivered to the City of Waukee at 230 W Hickman Rd, Waukee, IA 50263 - Attention Rebecca
Schuett, in sealed envelopes marked with the Project Name and Name and Address of Bidder.
All bids shall be sealed and plainly marked. Any alteration of the bid form may be cause for
rejection of the bid. Signed copies of the Resident Bidder Form, Targeted Small Business
Form, and Construction Progress Schedule are to be included with the bid.
B. Each Bid shall be accompanied by a Bid Security in the amount of three percent (3%) of the
total bid submitted. Bid Security must be in the form set forth in the Instructions to Bidders and
submitted in a separate sealed envelope clearly labeled Bid Security. Bid Security must be in
one of the following forms: Certified Check, Cashier’s Check, Certified Share Draft or an
approved Bond Form.
C. The successful Bidder will be required to furnish a Certificate of Insurance and Performance
and Labor and Material Payment Bonds both in an amount equal to 100% of the Contract
Price and in accordance with other requirements outlined in the Bid Documents.
D. Should the successful bidder fail or neglect to furnish satisfactory performance/payment
bonds, refuse to enter into a Contract on the basis of the bid, or fail to meet the requirements
of this Notice and the specifications regulating the award, the bidder’s security may be
retained as liquidated damages. No bidder may withdraw its bid for a period of forty-five (45)
calendar days after the date and hour set for opening of bids.
1.5 IOWA STATE SALES TAX
A. This project is tax exempt. DO NOT include Iowa State Sales Tax in any calculation of Bid
totals. Contractors and Suppliers will be provided an Iowa sales tax exemption certificate for
this project.
B. All bidders must provide a statement regarding the bidder’s resident status. This statement
shall be on the Bidder Status Form designated by the Iowa Department of Labor
commissioner and available online. The statement must be signed by an authorized
representative of the bidder. Failure by any bidder to provide a completed statement with its
bid may result in the Board of Education rejecting the bid as non-responsive.
1.6 BASIS OF BIDS:
A. The City Council of the City of Waukee reserve the right to conduct such investigations as it
deems necessary to assist in the evaluation of any apparent low bidder to establish the
qualifications, experience, number of employees, and responsibility of the bidder to do the
work. The District may require submission of AIA Document A305, Contractor Qualification
Statement, at its discretion to the apparent low bidder.
B. The Bidder shall include all requested Forms and attachments with their submission of the Bid
Form; failure to comply may be cause for rejection. Consideration of bids and the award of
contract may be made by the City of Waukee to the lowest responsive, responsible bidder
determined on the basis of a combination of the base bid and selected alternates at its
meeting on March 16, 2026 at 5:30 PM, at the Waukee City Hall. The right is reserved to reject
any and all bids, or any part thereof, and to waive informalities or irregularities and to enter
into such Contract or Contracts as shall be deemed in the best interests of the City of
Waukee.

C. By virtue of statutory authority, a preference will be given to products and provisions grown
and coal produced within the State of Iowa.
D. All bids will be governed by applicable provisions in the Iowa Code and Board Policies.
E. A Pre-Bid Meeting is scheduled for February 12, 2026 at 2:00 PM, local time, at the existing
building, 410 6th Street, Waukee, IA 50263.
