Kitchen (1165 SE University Avenue)
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: The applicant is requesting approval of a site plan for a
commercial building. The property is located north of SE University Avenue
and east of SE Alice’s Road, containing 1.03-acres.
The project includes the construction of a single-story restaurant building.
The building is 2,425 square feet in area and 22-feet in height. The site
includes a drive-through lane. A trash enclosure is shown at the north side of
the site, a detached structure for an employee shelter is shown to the north of
the building to assist with drive-through ordering, and an outdoor patio is
shown south of the building. A monument sign is proposed at the southwest
corner of the site, off of SE University Avenue.
There are several existing accesses into the site. One access is provided
directly into the site from SE University Avenue along the south. No new
accesses are proposed. A pedestrian connection will be provided into the site
from the trail along SE University Avenue.
A total of 37 parking spaces are required and they are providing 46 spaces,
including 2 accessible stalls. The required number of queuing spaces are being
provided for the drive-through.
Public utilities are provided to the site. Storm water detention will be provided
with the existing pond located off-site, to the west of this site.
A minimum of 20% of the site is required to be open space, they are providing
27%. They are providing the required amount of plantings.
The building elevations are proposed to be constructed of mostly stone veneer
and wood look insulated wall panels. The trash enclosure and employee shed
will be constructed of the same stone veneer as the building.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission
reviewed the site plan request at their meeting on January 27, 2026, and
recommended approval:

Melissa DeBoer, Planning Coordinator, introduced the request for approval of a site plan for a
commercial building, as requested by Chicken Coop Real Estate, LLC and Charlotte’s Kitchen LLC,
represented by Rick Baumhover of Bishop Engineering.
The property is generally located north of SE University Avenue and east of SE Alice’s road,
containing approximately 1.03 acres. The location was platted as part of Williams Pointe Plat 5 in
2015. This is the only undeveloped lot remaining within that plat.
The project includes the construction of a single-story restaurant building for Charlotte’s Kitchen. The
building is 2,425 square feet in area and 22 feet in height. The site includes a drive-through lane
located along the north and west sides of the building. A trash enclosure is shown at the north side of

The site plan is in general conformance with the Site Plan Ordinance, Comprehensive Plan, and
Planned Development. Staff recommends approval of the site plan for Charlotte’s Kitchen, subject to
remaining staff comments.
Discussion as follows:
• General discussion of entrances to the site and queueing stalls
• Marty Barkley, of Accurate Development, provided information related to queueing design
directing customers to exits other than University Avenue
• Marty also provided information on the employee shelter location and its design for use by
employees with tablets taking orders and/or sheltering
Motion by Commissioner Broderick for Approval of a Site Plan for Charlotte’s Kitchen (1165 SE
University Avenue), seconded by Commissioner Bannister. Ayes: Broderick, Streit, Beenken, Lohse,
Tuel, and Bannister. Nays: None. Motion carried.
RECOMMENDATION: Approve the resolution subject to remaining staff comments.

IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of
the Site Plan for Charlotte’s Kitchen, subject to remaining staff comments on February 2, 2026;
AND,
WHEREAS, the Site Plan for Charlotte’s Kitchen is in general conformance with §160 – Site
and Building Development Standards Ordinance of the Waukee Municipal Code; AND,
WHEREAS, the Site Plan for Charlotte’s Kitchen is in general conformance with §161 –
Landscaping and Open Space Ordinance of the Waukee Municipal Code; AND,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa on
this 2nd day of February, 2026, that the Site Plan for Charlotte’s Kitchen is approved.

remaining within that plat.

2.SUBGRADE PREPARATION AND PAVEMENTS WILL BE CONSTRUCTED FOLLOWING RECOMMENDATIONS IN THE SOILS REPORT. APPROVED SOILS
ENGINEER MUST SIGN OFF ON SUB BASE PRIOR TO ANY PAVEMENT BEING PLACED.
3.SEE DETAILS FOR ALL PAVEMENT THICKNESS.
4.ALL PEDESTRIAN WALKWAYS THAT UNLOAD INTO A VEHICLES TRAVELED PATH MUST HAVE A.D.A. DETECTABLE WARNING PANEL(S) AS PER A.D.A.
REGULATIONS. PANEL TYPE & COLOR SHALL BE PER CITY STANDARD.
5.ALL WALKS, PARKING LOTS, HANDICAP PARKING, RAMPS, ETC. SHALL COMPLY WITH ALL A.D.A. AND CITY CODES. HANDICAP PARKING SIGNAGE IS
REQUIRED FOR ALL HANDICAP STALLS AND SHALL BE CONSIDERED INCIDENTAL. IN EVENT OF A DISCREPANCY BETWEEN THE PLANS AND THE
A.D.A./CITY CODES THE A.D.A./CITY CODES SHALL GOVERN. CONTRACTOR SHALL BE RESPONSIBLE FOR ENSURING A.D.A. CODES ARE MET.
UTILITY NOTES:
1.QUANTITY CALLOUTS ON PIPE LENGTHS ARE APPROXIMATE AND SHOULD BE USED FOR REFERENCE ONLY.

TRAFFIC CONTROL NOTES:
1. The Contractor shall furnish, install, maintain, clean, repair, adjust and remove all traffic control devices on the
project. All signs shall be reflector and conform to MUTCD (Manula on Uniform Traffic Control Devices) standards.
2. Contractor shall protect all existing signs and poles. Damaged signs and poles shall be relocated and replaced at
contractor's expense.
3. All traffic control signing, except any road closed barrier, must be placed a minimum of 2' behind the face of the curb
or 6' from the edge of the traveled way if no curb is present.
4. The proposed signing may be modified to fit field conditions, prevent obstructions, and accommodate construction
staging, upon approval of the Engineer.
5. Flaggers must be provided when work temporarily obstructs traffic lanes adjacent to the project, incidental to other
work on this project.
6. Sidewalks along project shall be closed prior to commencement of any activities in the area.
7. Orange safety fence shall be placed along sidewalk side of removal area.
8. Contractor shall follow SUDAS Figures:

2.SWPPP PLAN AND NARRATIVE ARE CONSIDERED A LIVING DOCUMENT AND WILL NEED PERIODIC

4.INSTALL INTAKE PROTECTION IMMEDIATELY AFTER STORM SEWER CONSTRUCTION.
5.INSTALL FINISHED PAVING INLET PROTECTION IMMEDIATELY AFTER PAVING IS COMPLETED
AROUND INTAKE.
6.CONTRACTOR SHALL BE RESPONSIBLE FOR SUPPLYING A CONCRETE WASHOUT IN ACCORDANCE
WITH NPDES GENERAL PERMIT NO. 2 DURING ALL CONCRETE WORK. CONCRETE WASHOUT
SHALL MEET SUDAS SPEC 11050.
7.CONTRACTOR SHALL BE RESPONSIBLE FOR SUPPLYING TEMPORARY RESTROOM FACILITIES.
SANITARY WASTE SHALL BE DISPOSED OF PER ALL FEDERAL, STATE AND LOCAL REGULATIONS.
