AGENDA ITEM: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1
to C-1, a parcel to be known as Orange Commercial Development [third
(final) reading]

SYNOPSIS INCLUDING PRO & CON: The property owner, Hurd Land Company, LLC, has
requested that the third consideration of the ordinance be tabled to a
future meeting to allow them additional time to work with the applicant,
Orange Commercial, on additional details for the future development of
the subject property. The applicant requests that the third consideration
be tabled until the meeting on April 20, 2026.

AN ORDINANCE TO AMEND CHAPTER 169, ZONING ORDINANCE, CITY OF
WAUKEE, IOWA BY AMENDING THE ZONING FROM A-1 (AGRICULTURAL
DISTRICT) TO C-1 (COMMUNITY AND HIGHWAY SERVICE COMMERCIAL
DISTRICT) [ORANGE COMMERCIAL DEVELOPMENT]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Section 160.02 of Chapter 169, Waukee Municipal Code, Zoning
Ordinance of the City, adopting the Official Zoning Map, is hereby amended by amending the
following real estate (Property) from A-1 (Agricultural District) to C-1 (Community and
Highway Service Commercial District) for property legally described as follows:
THAT PART OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER,
SECTION 26, TOWNSHIP 79 NORTH, RANGE 26 WEST, POLK COUNTY, IOWA,
DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHWEST CORNER OF SAID SECTION 26; THENCE
SOUTH 89 DEGREES 44 MINUTES, 22 SECONDS EAST (ASSUMED BEARING), ON THE
SOUTH LINE OF SAID SECTION 26, A DISTANCE OF 1323.20 FEET TO THE
SOUTHEAST CORNER OF THE SOUTHWEST QUARTER OF THE SOUTHWEST
QUARTER OF SAID SECTION 26; THENCE NORTH 00 DEGREES, 09 MINUTES, 50
SECONDS EAST, ON THE EAST LINE OF SAID SOUTHWEST QUARTER OF THE

THENCE SOUTH 89 DEGREES, 41 MINUTES, 18 SECONDS EAST, ON SAID NORTH
LINE, 1248.22 FEET TO A POINT ON THE EAST LINE OF SAID SOUTHWEST QUARTER

Section 2. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance
shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect upon its final passage,
approval and publication as provided by law.
