HomeMy WebLinkAbout2026-04-06 Ordinance 3179_Park Regulations, Use of Shelters-Rental FacilitiesORDINANCE NO. 3179 AN ORDINANCE TO AMEND CHAPTER 26, PARK REGULATIONS, BY AMENDING SECTION 26.07, USE OF SHELTERS, AS SECTION 26.07, USE OF RENTAL FACILITIES WHEREAS, the City of Waukee has established rules and regulations to facilitate the enjoyment of facilities and recreational trails within City of Waukee parks; AND, WHEREAS, the City of Waukee Parks & Recreation Department has determined that it is necessary to amend Chapter 26, Park Regulations, Section 26.07, Use of Shelters, to amend deposit requirements for rental facilities and to more accurately reflect current rules and regulations governing the use of rental facilities; BE IT THEREFORE ORDAINED by the City Council of the City of Waukee: Section 1. Chapter 26, Park Regulations, Section 26.07, Use of Shelters, is hereby amended as follows: 26.07 USE OF RENTAL FACILITIES. 1. Reservations; Fees. Rental facilities may be reserved for the exclusive use of groups of persons or organizations for a fee as established by resolution of the Council. 2. Deposit Required. Any person reserving a rental facility shall deposit a sum as established by resolution of the Council with the Parks and Recreation Director, and if such person fails to leave the facility in a clean and undamaged condition, such person shall forfeit the deposit, in addition to any other remedy the City may have for any damages. Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provisions or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
