HomeMy WebLinkAbout2026-05-18 I01H_02 Amended and Substituted Lease Agreement_204 W Hickman RdAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: May 18, 2026 AGENDA ITEM:Consideration of approval of a resolution approving Amended and Substituted Lease – Business Property [SPLaw Properties, LLC] FORMAT:Resolution SYNOPSIS INCLUDING PRO & CON: The City has leased the property at 204 W. Hickman Road since September 2019 for use by the Community Development Department. Once the anticipated renovation of the building located at 1300 SE LA Grant Parkway is complete, the Community Development Department will relocate to that space. The original lease was for a period of ten years, however, the lease included a provision that allowed the City to end the lease at the end of year seven which would be September 15, 2026. City staff has worked with the property owner to extend the lease terms through January 2027 at which time the lease would end. All remaining terms of the lease including monthly rental costs remain the same. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: The City Attorney prepared the revised lease and the owners of the property have agreed to the terms and signed the amended lease. RECOMMENDATION: Staff would recommend approval of the proposed resolution. ATTACHMENTS:I. Proposed Resolution II. Amended and Substituted Lease PREPARED BY:Brad Deets, City Administrator REVIEWED BY: I1H2 THE CITY OF WAUKEE, IOWA RESOLUTION 2026- APPROVING AMENDED AND SUBSTITUTED LEASE – BUSINESS PROPERTY [SPLAW PROPERTIES, LLC] (204 W. HICKMAND ROAD) IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, the City of Waukee previously entered into a lease agreement with SPLaw Properties, LLC for property located at 204 W. Hickman Road in September 2019 (Resolution 19-332); AND, WHEREAS, with the completion of the renovation of the City owned property located at 1300 SE LA Grant Parkway, the leased property at 204 W. Hickman Road will no longer be needed for use by the City; AND, WHEREAS, SPLaw Properties, LLC have agreed to terms of an Amended and Substituted Lease for the property at 204 W. Hickman Road with a termination date of January 31, 2027. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this 18th day of May, 2026, that the Amended and Substituted Lease with SPLaw Properties be approved. ____________________________ Courtney Clarke, Mayor Attest: ___________________________________ Rebecca D.
