to Agreement for Professional Consulting Services with Shive-Hattery,
Inc. [2026 Downtown Street Improvements]

SYNOPSIS INCLUDING PRO & CON: The original Agreement was approved on
February 3, 2025 (RES#2025-068) with Shive-Hattery, Inc. for professional consulting
services for the 2026 Downtown Street Improvements project. The original Agreement was
for the Not To Exceed (NTE) amount of $210,000 for basic design services and $85,000 for
construction services. The original Agreement was for a total amount NTE $295,000. The
amendment would increase the contract by $40,500 ($32,000 for Basic Services; $8,500 for
Construction Services). The primary addition is the electrical and lighting design, which was
excluded in the original Agreement. Shive had hoped to fit this additional work within the
original NTE amount but did end up going over budget. The amendment also includes
additional scope and fee for the construction phase of the project. Part of this covers the
anticipated submittal review and oversight for the lighting/electrical elements, and we are also
anticipating some additional time for general project construction review. This is hourly, so if
Shive doesn’t end up using the time, it will not be billed.

APPROVING AMENDMENT NO. 1 TO AGREEMENT FOR PROFESSIONAL
CONSULTING SERVICES WITH SHIVE-HATTERY, INC.
[2026 DOWNTOWN STREET IMPROVEMENTS]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City entered into an Agreement for Professional Consulting Services with
Shive-Hattery, Inc. on February 3, 2025 (RES #2025-068) for the 2026 Downtown Street
Improvements project; AND,
WHEREAS, Amendment No. 1 is for compensation for the addition of electrical and lighting
design services that were not included in the original agreement and additional scope and fee for
the construction phase of the project related to electrical and lighting elements.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Amendment No. 1 to the original agreement with Shive-Hattery Inc. is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 1st day of June, 2026.

City of Waukee and Shive-Hattery, Inc. (S-H) agree to amend the Original Agreement as follows:
PROJECT DESCRIPTION
The Project Description is revised as follows:
ADD
The project includes electrical upgrades along the reconstructed Walnut Street and within Triangle Park.
New City-owned street lighting will be installed, including both post-mounted light fixtures and festoon
lighting over the Walnut Street flex street area. Power receptacles will be included with the Walnut
Street light poles and in pedestals within the planter areas at each end of the flex street. The electric
service feed to Triangle Park will also be replaced and rerouted to allow for removal of existing
overhead electric facilities.
SCOPE OF SERVICES
Tasks for the Scope of Services are revised as follows:
I. Basic Services of the Consultant
1. Project Management
A. Project Meetings
1) The consultant shall prepare project exhibits/displays and attend two
(2) meetings with City Staff and the Waukee Downtown Business
Group to receive feedback and share project updates.
2. Surveys and Mapping
A. No changes.
3. Conceptual Plan Development
A. Conceptual plans and cost opinions for Walnut Street will include options for
replacement of existing street lighting and addition of electrical receptacles.
B. Aesthetic treatment options explored will include aesthetic lighting elements.
4. Stormwater Design and Engineering
A. No changes.

5. Preliminary Design and Plans
A. Add preliminary electrical and lighting design including plan sheets (P
Sheets).
B. Include electrical and lighting components in preliminary opinion of probably
construction cost, including coordination with vendors for pricing of aesthetic
lighting elements.
C. Coordinate with outside vendor to provide product/price quotes for City
review for audio system equipment to be installed at Triangle Park/Walnut
Street flex street area.
6. Utility Coordination
A. No changes.
7. Final Plans and Specifications
A. Add final electrical and lighting design including specifications (Division 26)
and plan sheet (P Sheets).
B. Include electrical and lighting components in final opinion of probably
construction cost.
C. Coordinate final electrical design to accommodate audio system equipment to
be procured by City and installed separate from flex street project.
8. Permitting
A. No changes.
9. Bidding
A. Coordinate collection of supplemental information from apparent low bidder to
document responsibility of bidder.
II. Construction Services
1. Construction Administration
A. Construction administration services shall be provided for additional
improvements contained in this scope of services.
B. Construction administration shall consist of the items included in the original
construction scope of services.
1) For budgeting purposes, an additional 30 hours of engineering has
been included for interpretation and clarifications of the plans, as well
as additional site visits to review the progress of the Contractor’s work.
2. Resident Construction Observation services are not included.

AGREEMENT
When accepted by both parties, this Amendment will amend the Original Agreement and is subject to all
other terms and conditions of the Original Agreement. Original, facsimile, electronic signatures or other
electronic acceptance by the parties (and returned to Shive-Hattery) are deemed acceptable for binding
the parties to the Amendment. The Client representative signing this Amendment warrants that he or
she is authorized to enter into this Amendment on behalf of the Client.
